Help about "when claim started"

After a few months of my ex using maintenance as a weapon (ie, if I annoyed him or didn't agree with him then money would stop!!) I decided to go to CSA because I hadn't recieved a penny off him for a month!!!
I rang CSA and was told about a new "government initiative" they wanted everyone to try where they tell NRP how much to pay and we sort it out amongst ourselves and if they didn't agree then CSA would take action!!! I didn't want to try this as I wanted as little contact with him as possible!! I was told it was a new thing and wouldn't be any different and I could esculate to a claim whenever I wanted not a problem!!! Eventually I thought I'd give it a try!! Well after several more rows with darling ex and some very hurtful things said, I decided I needed to esculate to a claim!! I rang back CSA and was told the payment would only go from that date when I escalated to a claim!!! So that was another few weeks without payment!!! I said about what I was advised and they said "sorry u must have been misinformed!!!"
So for three months my ex only had to pay £80 for two children!!!
I called to dispute his self employed income and they said "he had a right to be believed"!!! He won't have his kids much because he works 6/7 days a week, yet gets 140 a week??!
Again, what about my child's "rights to a decent life"

    bin there done that brought the t-shirt - as your ex is self employed the CSA have to rely on the figures that he gives them as his actual earnings, the assesment couls be as low as £5 per week, he could even up with a zero assesment,

    for example - say he's working 6 days a week, driving a posh car, and has every gadget under the sun, if his paperwork shows he doesn't have the money, he doesn't have to pay.

    If you do get an assessment - then the week the money does not come through, ring the CSA asap, as things change (usually the NRP) trying to pull a stunt in not paying and your be left high and dry till they get it reinstated, if that happens the money owed will be added to his arrears........

    as for you "childs right to a descent life" - it will be up to you to make sure it happens.

    Apologies if I sound negative, but my NRP seems to forget he has a daughter we have to fight tooth and nail for any money that we get.

    Once the new claim starts it could take 13 weeks to get sorted, and you wouldn't get the money backdated.

  • My payments have been sorted now (although I know they aren't what they should be) but it's just because of the Misinformation from the CSA that I recieved, I lost out on a few weeks payments!!!!
    Grrrrrr!!!!!
