can i stop eviction from my home?

iv rented my house 15yrs on a short term tenantcy yearly.my land lord has died and estatesgent has informed me that im now on a monthly roll over and the house is being auctioned with me as tenant..my question is...can the new owners evict me? and if they have the right to evict me how can i prelong the process..with thanks.

    You say you have been a tenant there for 15 years, did the tenancy actually start before 15th January 1989?

    If it did, then you probably have a 'regulated tenancy' and therefore have some very strong rights, those rights will make it virtually impossible for a new landlord to evict you and will also ensure you continue to pay a low rent.

    Do you still have your original agreement and any notices that might have been given to you at the time?

    Op's original tenancy may have a cap on rent increases as part of the contract.

    OP: the agent says your on a monthly contract, but u also say you renewed yearly, so are you sure your not in a fixed term

    OP - Any potential new owner/landlord may well find it attractive precisely because it's got a good, reliable long-term tenant. I know I would. It probably puts you into a slightly better position. The shonky shysters would probably avoid the hassle of getting shot of you, so be less interested in the property.

    Further to the above, you may (only just) be an assured tenant as opposed to an assured shorthold. Do you remember the exact date you took up the tenancy? If it started before the 15th January 1989 and 27th February 1997 and your landlord did not give you a sectin 20 form to sign then you have more protection against eviction.

    You can find out more on your rights regarding eviction on the Shelter website.

    Also, if you are assured then there are more rules regarding rent increases than in a current assured shorthold.

  • Only guaranteed way to prevent eviction is you buy it.

    You do not have to allow viewings or valuations etc. Matters could be arranged so nobody else wanted to buy it.....

  • they can not buy a house, then evict you so they can live there, they are buying the house with a sitting tenant, so chances are it will be LL who buys it, if its some one who wants to evict you they will have to try a different route, ie, bribe you to leave

    Of course they can. But it'll take time and money to do, same as for any other landlord seeking an eviction.
