They can, legally, make any rules they like regarding those extra five days above those to which you are entitled under the WTRs. If they wanted they could say you couldn't take any holiday during your notice period - but obviously they wouldn't prevent your taking New Years Day and didn't stop you taking 2 January.
What they can't do is not pay you for WTRs holiday accrued at the time you leave.
We have provided different answers as to how much holiday you will have accrued by COP 17 January. (There are various reasons for this - like not taking into account that holiday is accrued within a year, not added after it has ended or whether to look at only worked days or calendar days/weeks.)
So you need to find out what method your employer uses to make the calculation. Perhaps the promised link will materialise?0 -
I'll come back when I find more. But really, over the phone, their was no calculation, they simply said, you don't earn anything until you complete the first month.
I'll try and be as thorough as I can before coming back. It is a little confusing...0 -

my workings show that they accrue 1.4 or if take account of the 0.6day extra they took as holiday 1.33 accrue.0
