    Our rental agreement states 60 days notice to be served at any time. No getting out of that! We have been here for a year so past the 6 month minimum term.

    I may be wrong here, but after your initial fixed term, I'm fairly sure it is law that you only need to give one months notice.

    I don't know if it's worth looking further in to that as it could speed things up ?

    OK - so today we heard this coming Wednesday they will be confirming the status of the company.

    If the company goes into Administration - I inform the MA/Bank, is this likely to affect the Mortgage or we better off sorting out a new job now (same job role and money(+))? Tbh I dont understand her position when they do go into administration, is she still employed?

    If so, the tenancy is not correct and statute applies instead. You have to give one month's notice, to coincide with the ending of a tenancy period.

    I assume you paid a deposit, it was protected within 30 days of you paying it, and you were also given the prescribed information about the deposit scheme within the same time frame? If so, the deposit scheme are likely to disagree with a LL's claim to retain money for any excess 'notice period'. If not, then the LL is on a sticky wicket because you can legally sue for return of the deposit plus a penalty of up to 3 times the deposit ... always a useful bit of knowledge to have up your sleeve if necessary.

    If possible, try to exchange a couple of days before the end of one rental period, immediately give notice on your tenancy, and complete about 2 weeks later - thus giving you a further 2 weeks to do stuff in the new house, move, and clean the rental before handing back the keys.

    I cannot see if I have signed a rental agreement with it stating 60 days that I would get out of it. No doubt the difference could be clawed back by being fussy with damage (none touch wood). Handy as you say if it works out. (We are in England).

    Phoned up Abbey, explained that my OH potentially will change jobs (she will have to if made redundant). His reply was that it does not matter unless we get to the end of the mortgage offer date. Will ring again tomorrow and confirm with another as he suggested there would be no need to speak to the underwriters.

    OP, I am pretty sure that the contract is not worth the paper it's written on as far as the notice period goes, but I suggest you create a new post in the House Buying Renting Selling forum, post up the whole of the wording of para 5 and see what those who are more expert than me think. (Might be worth deleting the actual dates and state that they are exactly 6 months apart, expiring a couple of months ago - this is just to maintain some anonymity).

    That means this thread can continue on the mortgages issue, and the other forum can focus on the rental notice issue. Do say you were redirected there from here.
