No Dec pay and want me to wait till end of Jan

Hello,

I returned to work from maternity leave on the 6th Dec, and used up my annual leave, so I don't go back in the office till 6th Jan, but I didn't get paid in December due to my team leader not putting me back on the system at work correctly, and payroll thinking I was still on Mat leave.

I have now been told I ŵill have to wait till the end of Jan to get my missing wages as the management are not willing to pay the fee for the company to do an ad-hoc payment.

I don't feel this is fair as I have done nothing wrong but will have to struggle till the end of the month.

So I would like to know if they are legally allowed to do this, before I head back to work on Monday, they are a big company, a worldwide known brand, it would be nice to be able to put them in their place!

I would be grateful for any replies :)

    No they aren't. The issue is that you would have to go to court to compel them to pay it, which would take longer than a month so it's pretty much unenforceable.

    If its a large company then escalate within HR.

    it should have been automatic or done at the time you agreed the return to work date(to start the holiday)

    What about saying, you made the mistake I am down as being on maternity so the holiday has not happened I will take it now and have another month off.


    Double check they have the accrued holiday correct.
  • Ask them for an interim payment until pay-roll is sorted at the end of January. Make this request of your manager before you take it to HR.

    A payment in lieu of salary is easy and straightforward to do and your request is utterly reasonable.

    I have already asked for an emergency payment, but have been told that it will cost the dept £500 to do this! I only work part time so this is around the same as I get paid. My husband works for the same company and is going to check this for me tomorrow as it is a bit much, and I wouldn't put it pass them to try and fob me off.

    I did think about taking another month off but I start new hours on the 6th, but holiday pay should be at my old hours, this would just cause too much confusion for them!!

    I will give them the chance to change their minds before I go to HR, I am usually the sort of person to just end up going along with it, but don't think I should this time, I've worked for the company for 14 years, that doesn't seem to count for anything!

    Someone is telling porkies, ask your manager again for an advance and if they refuse make it clear to them that you are going direct to HR.

    To be honest, if it costs them £500 to make the payment then so be it, the fault is theirs and it should not be you that is out of pocket. Perhaps they should take this as a large hint to review both their return to work processes and their contract with their payroll provider (which sound utterly nonsensical to me).

    i love how employers now just say 'just wait' when it comes to lack of payment. we can't all pick n choose when bills come out.

    they just seem to 'expect' u to have 'funds incase we dont pay you'. totally disgusting.

    Hey guys, thanks for your advice. I wanted to update you. I returned yesterday and politely said that if they can't see a way of paying me this week I will have to contact HR & see what they can do, & hey presto, all approved and will be in my account by Friday!! I was really proud of myself, so many thanks again xx
