How long??

I was made bankrupt in April 2003 but dont know how long it is meant to last, I was told 3 years but havnt received anything from the official receiver who i was dealing with to say ive now been discharged, and im still finding it very difficult to get any credit, but have catalogues and mobile phone contract, does anyone know how long it will be until i can actually get a debit/credit card as i so want to shop on the internet as its cheaper?????:confused:

    Others who know more will probably be better than I on this, but from what I understand you can get a pre-paid credit card (sorry can't remember the names of them) for shopping online, and apparently the Co-op are quite good at giving Bank Accounts to BRs and you might be able to get an Electron Card with that, that's what I have/had on my normal Bank Account for the last 5 or so years and now it's easy to use it online/in shops, nearly everyone accepts it it seems. Or just approach the different banks and see what they can do re a debit card.

    I would say get in contact with your OR to enquire about discharge and see what they say :)

    or do a search here..should list if your discharged or not

    select the option bankrupcy/IVA search should take you to a new page then select do a bankrupcy search online..you should be listed here, bear in mind the bankrupcy will stay on your credit file for 6yrs so credit will be difficult to source..if you are discharged check your credit files experian etc sometimes your discharge wont show & they rely on you making ammendments

    Is it not 6 yrs till you can get full credit again? and then it will be hard as you wont have any credit its a catch 22 situation

    In theory you should have been discharged on 1st April 2005 under the provisions of the Enterprise Act 2002 which came into force in April 2004, as you can see from the official info below.

    You will also see that you would not automatically be informed of this.

    I would check with your OR to get confirmation of this, but you can also check the insolvency register to make sure you are no longer listed.

    ix Transitional provisions

    Where an individual is already bankrupt at 1 April 2004, the EA2002 may still operate so as to reduce the discharge period. For those first-time bankrupts where the bankruptcy order was made before 1 April 2004, there will be automatic discharge on either:
    • the date before 1 April 2005 on which discharge is due; or
    • 1 April 2005, whichever is the soonest
    This means, for example, that generally a bankrupt subject to a bankruptcy order made on 2 August 2001 would be discharged on 2 August 2004 as they would have been, notwithstanding EA2002. However, in the case of a bankrupt adjudged on 2 August 2002 who would have otherwise been discharged on 2 August 2005 the discharge date would be 1 April 2005.


    This redresses the inequitable situation that could have existed in the case of an individual made bankrupt on 31 March 2004 who would not otherwise have been discharged until 31 March 2007, in contrast to an individual subject to an order made on 1 April 2004, who would be discharged after 12 months on 1 April 2005.


    Existing bankrupts will not receive an individual letter regarding their amended discharge date.

    In the case of those bankrupts not entitled to automatic discharge, discharge will depend on the reason why they do not qualify :
    • Where the bankrupt is a second time bankrupt and has previously been an undischarged bankrupt in the 15 years prior to the current bankruptcy and remains undischarged from the second bankruptcy, he/she will be discharged either on 1 April 2009 (5 years from the legislation coming into force) or any earlier discharge date ordered by the court after 1 April 2004. The bankrupt may still apply for discharge to the court 5 years after the date of the bankruptcy order if this falls before 1 April 2009. (For more information see Case Help Manual part: Second or Subsequent Bankruptcies)
    • Where the automatic discharge was suspended prior to 1 April 2004 for failure to co-operate or the like, these provisions will not apply.
    • Where, at 1 April 2004 a bankrupt was subject to an order suspending his/her discharge and subsequently complies with the terms of the order, the period of the bankruptcy remaining following an application by the official receiver to lift the suspension will be one year or the balance of the period remaining to run whichever is the shorter.

    If you can't find your name, then it usually means that you have been discharged from bankruptcy. The OR does NOT always inform people of their discharge.
    You could contact the court, at which you were declared bankrupt, quote your case number and date, they will, then confirm at which date your discharge was granted and should issue you with a certificate of discharge - although there is a fee for this.

    Of course you can, doh:o Thanks Rog2.:D Not with it today.:confused:

    It's £60 to get a copy of the certificate, but simply confirming the discharge should cost nothing.

    Havnt had time to ring today as been really busy am going to do it tomorrow, have to find the number first and got to find my ref number, which i think is at my mums in her filing cabinet, as i thought it would be safer there as i lose everything!!:rotfl:
