Can an employer refuse to pay SSP if you resign?

  • I was paid my SSP from the 20th of october to the 17th of november. I had to quit on the 2nd of december - hence there are 2 weeks I haven't been paid. Doctors notes were supplied right up until termination.

    Can an employer pick and choose if they pay you SSP? My understanding was they could only do this outside of the 28 week period.

    What you can do if your employer won't pay you contractual sick pay

    If your employer won't pay you the contractual sick pay that you are entitled to, this is breach of contract. You could make a claim for unlawful deduction of wages to an employment tribunal. You may need to raise a grievance with your employer first.
