Never signed contract - is the debt enforceable?

Hi everyone,


After having a long discussion with a friend today I wanted to ask your advice.


He has a debt with V*rg*n media, which has defaulted. He says that he ordered the product on the phone or online (he can't remember which) but never signed the contract they sent him.


Does this mean they cannot enforce the debt? Or does the phone call/online order count as 'accepting the t's & c's? If so why even bother sending him the contract out in the first place?

    Most things these days are started online or over the phone.

    It's just T&C's they post out.

    I guess it depends on if the product was supplied?

    I seem to remember our installation guy finalising the contract with us at the end of installation.

    Did anyone have to come out to your friend or was any service supplied by VM?
  • Yes it was installed and used for several months before he lost his job. Then he fell behind with payments which just kept increasing and increasing. Though I don't think he ever spoke to them and told them his situation, rather ignored the letters before and after being cut off.

  • Had something similar to this happen years ago. Tried to cancel my contract with them as I was moving in with other half, who already had Virgin Media package.

    They insisted I pay the rest of my contract. While packing to move I found the contract theyd sent, my copy and theirs, which I'd signed and never sent back.

    They told me that upon using the equipment and services meant I was agreeing to T&Cs. I mentioned I still had both copies and they said someone would call me back.

    As a 'goodwill gesture' they waived the rest of that year's subscription and allowed me to cancel.

    My account was up to date so no money owed, your friend might not get the same 'goodwill gesture'.

  • Yeah, DD contracts are usually taken as agreed upon as the first payment is made. seals the agreement. Used to work for a BACS bureau....

    Another person wanting to avoid paying what they owe. Don't they realise the impact further along the line on people's jobs etc? As well as being an insult to hard working folks who don't want to squirm out of paying what's owed because they have respect for themselves and others!
