Isme would not return my receipt

sent 3 items back to isme but they only said they received one back but not other 2 and they expect me to pay for items which I returned

I have been trying to resolve this since December 2012 and still trying to get it sorted. all they say is the post office gave me a wrong receipt I needed one with a barcode

sent at least 60 emails and numerous letters

isme recently told me to send them my original returns receipt from post office
which I did recorded delivery and was signed for in march 2013
so they could make a claims with the post office.
then was told they could not help me.

I contacted someone else again at isme to go through all this again and again
was told all I could do was make my own claim with the post office

I told them many many times now that I cant do this as isme still has my receipt.

she replied back to me by letter saying nothing she can do but make my own claim.
I am wondering is she stupid or just not reading my letters to her.
THAT I DO NOT HAVE THE RECEIPTS TO DO SO AS ISME HAS THEM AS THEY HAD ASKED FOR THEM.

they know I cant claim without the receipts, they expect me to pay for items which I returned and are now making extra charges to my account. I am very worried about all this and have been ill with all the stress of it and really don't need this as have to babies to take care off.
I also have never signed any credit agreement with them would this make any difference?
please any help would be most welcome especially any legal advice. surely its not my fault what receipt the post office gives out. :mad:

    Looking at is me returns policy, I see no mention of the post office.
  • you could return through post office as have done this before with isme. you had choice this or courier

    If you paid for the return post (rather than isme) then the claim for the missing parcel is down to you, not isme.

    You might be able to get something as good will if you can prove isme asked you to send them the receipt - although you only have 80 days to claim for loss with Royal Mail from the date of posting, so looking at the dates you have given, you may have been outside of the time you could claim from Royal Mail anyway, in which case isme having your receipt would have made no difference anyway.
  • It sounds a bit of a pickle and not your fault at all. However.. hindsight is a wonderful thing - you should have made a claim from your own insurance for the price of the returned products at the post office.


    I believe that when you open an account with isme, like many others - you open a credit account upon signing up. No signature is needed other than a tick box onscreen to say you confirm to their Terms on submittal of the order.


    To be honest I'd continue down the route of 'you asked for my post office documentation and said you could claim' statement they gave you - as this was not the correct information.

    I think part of the problem is you haven't followed their preferred returns procedure. If the post office didn't give you the correct receipt you do have to bear responsibility if you didn't check this at the time.

    What service did you ask and pay for at the post office? It may not be that you asked for the wrong receipt but that you chose the wrong service.

    Did you inform isme that you were cancelling the contract and returning the goods or did you just post them back?

    The OP has stated Recorded delivery,that has been signed for.

    OP. were the items in one package? Did you get a printed receipt with tracking number on it? or ye olde RD slip where the stickers were before being removed?

    Did the receipt have the weight on? If you want to take it to small claims court this could help prove you sent multiple items in the one box and not the one item they are claiminh
