How many hours holiday pay?

Hi, my husband works for a smallish local firm. He is paid by the hour a basic rate. His overtime rate starts after he's worked 12 hours.

He had Christmas Day and Boxing Day off, but his holiday is paid at a basic 8 hours per day. Is this right if his overtime isn't paid until after 12 hours? Doesn't that mean that they consider 12 hours to be normal working hours?

We are confused! Thanks for any advice.

    What is his normal working week? how many days per week and how many hours per day?

    Does he have any written statement regarding the particulars of his employment? Those to which he is entitled if he has worked there for more than two months include holiday entitlement.

    Do the written particulars say that his contract is for 8 hours a day? If they say that his contracted days last 8 hours then that is what a day's holiday should amount to. The fact that an enhanced rate for overtime doesn't kick in until after 12 hours in a day doesn't mean anything. What counts is what is written as being his normal day - and 8 hours sounds closer to a normal working day than 12 but this could depend on the area of work.

    How many hours does he normally work in a day?

    Thanks, he is an HGV Driver and normally works between 10-13 hours per day. I'm not sure what contract or anything he signed but I'll ask him when he gets back from work.

    He works Mon-Fri and also does fitting and maintenance on the lorries on Saturdays until just after lunch.

    He should get paid on the 12 hours shift as this is classed as compulsory overtime, if they only pay holiday based on his 8 hr shift he should not agree to the overtime and leave the workplace after 8 hrs
