Contract has ended but they want me to work?

Morning everyone :)
My contract officially ends on the 31st of December but they have given me two shifts for the 2nd and 4th of January. Am I legally obliged to do the shifts? I'm a christmas temp on a 15 hour minimum contract. It could be that I need to work my minimum hours out but if the contract is over, it's over isnt it? I wouldn't mind but I'm going away as I thought the contract would be over.
Many thanks in advance

  • What makes you think your contract finishes on 31 December?

What an odd question! Because my contract says that my start date is '20th October' end date '31st December'
    I hope that helps :)

No need to work any shifts you don't want to, even those within your contract, what are they likely to do?

Anyway, just tell them you're not available on the 2nd and 4th
Change is inevitable, except from a vending machine.

It is far from an odd question, it strikes to the core of your problem. Your answer shows that you have a well founded expectation that the contract comes to an end on 31 December.

So, if you do not want the shifts offered, you just need to let them know that you have other plans based on the end of contract they told you - and that you would be willing to continue working for them when you return from your break.

It only seemed an odd question because the premise of your question was a little ridiculous in the first place.

How can you be given shifts when you will no longer work there after the 31st? Unless they have taken you on for longer with a new contract?

Your contract ends on the 31st of December. They can't 'make' you work beyond that date. You may want to however.

There are more questions than answers going to arise from your post. We don't know whether you want / need work beyond the end of December, whether you are going onto benefits for instance and whether you would like your contract to be extended.

That shift on the 2nd could be very difficult to fill and could be a bargaining point for extending the contract, so you might want to consider that if you would like to continue working there. On the other hand you could be a student going back to your studies after the festive season and quite happy to end it there on the 31st.

Working longer than the contract’s end date
If an employee continues working past the end of a contract without it being formally renewed, there’s an ‘implied agreement’ by the employer that the end date has changed.

The employer still needs to be given proper notice if they want to dismiss the worker.

    Example

If a contract was for 1 month but the employee actually worked for 3 months, they’d still be entitled to the minimum notice period (1 week).
