Wonga / Moorcroft ... problems

Over summer i (pretty much) had to take out a couple of loans from wonga, as the companies i worked for had cash problems and we wasnt being paid on time. This led to not being paid at all so it all got a bit out of control, with work stress on top of no money stress

Fast forward to the last month, Wonga weren't great help, i couldn't resign my job as would be entitled to no benefits etc, and the interest piled up

The debt went to moorcroft and Wonga advised me of this, even confirmed by calling them and i had to contact Moorcroft. I used the national debtline letter template (after also speaking with them) for full and final offers when i received money via the insurance fund after receiving funds from the administrators

  • 20th November i received a written letter that in response to my full and final offer if they receive £x within 7 days it will be closed on their system and Moorcroft nor Wonga would make further contact to recover the balance, and that upon receipt this will be marked as satisfied by partial settlement with the CRA
  • This was paid next day (bank transfer)
  • I chased up to check, and received a letter as follows (exact wording)
''Dear Mr (me!)

re. wonga.com

We write to confirm receipt of your partial settlement of £x and can advise that neither we nor our client will take any further steps in relation to recovery of the remaining balance.

We will inform our client of this settlement so that if appropriate they can update the various Credit Reference agencies as satisfied by partial settlement

Yours sincerely''

  • 19th December i receive a text from Wonga thanking me for keeping my promise and hoping i will use the service again (as if)
  • 20th December i get an email from Wonga that the debt has been passed to BCW and they have been trying to contact me
Now i was pretty upset by this, i have called Wonga whose customer 'care' department didnt really care. She advised it will be passed to an excalation team as unable to help. I had to stay on the phone for half an hour in order to get a reference number for this as initially i was advised there wasn't one

There is no more £ for this at the moment, on my backside following the nightmare previous employer and am unwell as it is (stress is one of the triggers for my condition, which is why i had made every effort to satisfy all three debts so that it was something i didnt need to worry about

So my questions are pretty simple? Should this be resolved pretty swiftly by there escalation team, as is in black and white and i have copies of all letters, was all done in writing?
From any experience or knowledge, is there anything further i should do?

Many thanks

Sounds like they flanneled you with terminology.

You proposed a Full and Final Settlement but they responded with a Partial settlement proposal.

You should have rejected their letter and ensured it was in Full & Final.
As they only accepted a partial settlement, the remainder is still owed.
Neither Wonga nor Moorcroft are chasing you, the remaining debt has simply been sold on to BCW to chase the rest...sneaky.
  • Many thanks for your repy

I did run this past national debtline after receiving the letter, do have a reference for that call

Am really confused though, what does 'satisfied by partial payment' actually mean then?
The part am most confused 'further steps in relation to recovering the remainder' is obviosuly a complete lie as is has been passed/sold to BCW? am i completely wrong again here?

There is a couple of similar stories on this thread

    https://forums.moneysavingexpert.com/discussion/2271893

Take a look at your Credit File to see if the balance is £0 (probably not)

You could try complaining, you would be on a good footing as you specifically requested F&F but they have modified the proposal. You aren't the first and certainly won't be the last to be hoodwinked.

I'm surprised NDL didn't pick up on this immediately when they saw their reply.
  • Many thanks again

So upset about this, as if i knew this was to be the case, i would have paid installments as it really was all the money i had, and just wanted it clear and remove that black cloud over my head, obviously gathered again but i will follow it up.
To me, assigning the rest to another DCA is a further step regarding the remainder, even if they can. Feel conned in a way

The NDL Full and Final does say it will be marked as a P flag for partial settlement too, which is what was discussed with them (may have been some confusion there, but also if the dca know that people are using this leaflet/website advice can use it to their advantage too)
  • You need to complain, in writing, as they said they would not pursue the balance.

Partial settlement is correct on your credit file and even if it said fully settled, the default will still be a major issue.

  • DO NOT PHONE BCW WHATEVER YOU DO.

I owed them a small amount of money (£27 debt + there fees) phoned them up to explain that I would pay in 3 weeks time (Monthly pay-day) all seemed fine.

I made the mistake of using my mobile number to phone them, I got around 7 calls a day from there department that deals with the payment, asking if I was ready to pay etc.

Then I got texts from other companies, they'd sold my phone number to these people, the texts where pretty bad, about 10 a day, pretty much all of them where from Debt management companies, loan providers etc.

As you have said you've got an illness induced by stress, I wouldn't phone them as they'll make you a lot more stressful.
