Income tax overpayment - expired

Hi all,
I have just discovered that my previous employer put me on the BR tax code for the first 7ish months that I worked there and therefore I overpaid income tax that year. So far, so standard right? However, this was for the 08-09 tax year so HMRC are no help to me here.
Does anyone know how best to go about requesting my employer to reimburse me, or even if I stand any chance? Do I need to go down the legal route? They did not notify me of their error and I can prove it was their error, as I have a P60 from that tax year. By my calculations I have overpaid by over £1200 :eek:
Any advice whatsoever would be hugely appreciated! Many thanks in advance.

Your employer doesn't decide what tax code to put you on. They use the tax code that HMRC tell them to use depending on your circumstances at the time and whether or not you handed in a P45 or completed a P46 and what you completed on the P46 if that's what was used.However, this was for the 08-09 tax year so HMRC are no help to me here.

It's nothing to do with your employer unless you can prove they made a mistake which is very unlikely.Do I need to go down the legal route? It's very unlikely that they made an error. Why do you think they did? Did you have a P2 Coding Notice that shows a different tax code from the one your employer used?
If you had the P60 from that year you should have been well aware that your tax code was wrong and all you had to do was apply for a refund from HMRC. Why didn't you?Any advice whatsoever would be hugely appreciated! Many thanks in advance.
Basically forget about it. Unfortunately you made a mistake by not claiming your refund earlier and not taking responsibility for ensuring your tax was correct.0
