CSA help! Advice please

So me and ex split nearly a yr ago and money for the children has always been hit or miss.
There's 5 children all the ex partners and was in a relationship for 15yrs for him to find another so to speak :mad:

Anyways I'd decided CSA was poss best route as looking after the children on my own is becoming costly. Plus our youngest is 20 months so a long road ahead.

Here's where the problem is

Ex partner has a well paid job (so I think) on 2k+ each month (take home)
His misses he left for again on a 2k+ each month (yes I know her wage isn't included just saying house has 4k at least take home after tax n pensions etc)
Me and the children still reside in the family home due to not finding anywhere ATM near the children's school and they don't want to move nor do we see they should. the house we bought together but it's in ex partners sole name. So CSA have said due to this a variation needs to be done
No problem with that as he is paying the mortgage (£300pm)
CSA have come back with variation and said it will be £108 per week he has to pay for the 5 kids n obviously the mortgage. One part of me thinks yes no more struggling as he fails ATM to help out with buying the small things like jumpers socks etc but other part thinks is it too much??? Sadly ex will not come to an agreement with me and was his idea in the end to go to CSA so probably shot himself in the foot!??


My question is what would you do!? Things arnt easy as it is ATM between him and I as he's very abusive and makes threats. But I need to start looking forward for me and the kids?

    Sadly his max liability is 25% net, so about £500/month, so he can contribute £500 but you pay the mortgage, or £200 and pay the mortgage, the extras he does not have to consider sadly and only as he pleases, you may ultimately have to seek independant accomodation if he ceases to pay the mortgage, so you have to look at all the options and seek the best compromise or lesser of evils. Knowing the maximum liabilty you yourself may have to seek earning more and being inconvenienced to support your family, these things often come to roost around school uniform, birthdays and christmas times.

  • Im not advising to screw the system but if your struggling it might be best for you to rent some where with the children, you would get help towards the rent in the form of housing benefit and then would get the full £500 in CSA. Plus tax credits, child benefit etc.

    Your then not held to him or worried about becoming homeless if he decides not to pay the mortgage.

    I'm struggling a bit with the figures you've provided. If his take home pay is £2000 per month, even paying £300 mortgage, his liabilty would be more than £108 per month - more like £98 per week.......

    Perhaps there maybe some overnights ?

    There would have to be significent overnight contact to reduce the liability to £108 per month - I think it's a typo.

    NRP has no overnight stays.

    We are really looking for somewhere where the children stay within the area there school and friends are plus my friends as there my life line. But finding one that will accept housing benefit is becoming a task, but will make it a mission.

    Sorry I ment the variation they have worked out was £108 per week
  • That's more like it. If you think it's too much you can choose to accept a lower payment from him - providing he pays you direct.
  • He wants me to accept £150 per month and no negotiation but again feel 5 kids it's not acceptable :/ can't win really.

    Is that £150 a month and pay the £300 mortgage?
    That's starting to approach the £500 a month.
