REMO querie

Options
Hi everybody,

I am new here but have taken my time to search back posts to try to find an answer to my questions however I can not.

Background: I am PWC. NRP has paid through CSA every month for the last 3 years without fail since I opened the case after a year of broken promises from him to pay me directly. We had a DNA test done when my child was born as we were never a couple and he had his doubt (although I knew there was no one else) and he was put on the birth certificate. NRP decided he didn't want to be in our lives or contribute from day 1 but fortunately the law says different and I get monthly payments.

I have some concern about him possible moving abroad in the future. He has not been shy about hopping around the UK before I met him and last I heard he had moved another 100 miles away from where I assumed he still lived. Fortunately I assume he keeps the CSA up to date as I have had a couple of alterations due to change of circumstances in the last 3 years.

I am concerned as I know CSA can not do anything if he does move abroad and seeing as we are not in contact I wouldn't even know which country. Does he have to declare to CSA which country?

If he decided to move to a country not under REMO, I would not be able to receive any maintenance from him? If he chose to come back to UK will he have occurred arrears in the time he was in the non REMO country and be ordered to pay?
He is lucky his profession can take him anywhere in the world should he choose to.

If he ever moved to a REMO country, what of his details do I need to provide? I have not spoken to him for 3 years, apart from when he contacted to persuade me to close CSA and offered me higher payment which I did not accept as I did not trust him. All I have of him is his name. He has changed phone number, address and employers since I knew him so I have nothing. I read about a photograph - I don't even have this. I tried to search for him on Facebook and he seems to not have one anymore. I do not speak with any of his family.

This may seem extreme but I want to be prepared for my son's sake if anything were to happen. I'm afraid this is the quiet before the storm, as he was so difficult with payments in the past and has made it clear he resents us both.

There is another question I want advice on. I am not originally from UK (from EU) but have been here since 2000. If ever decide to move back to my home country, where do stand with that as I know I can not legally take my child out of this country without his consent. But I can't contact him? Maybe that is a question for a different thread.

So sorry for all the questions. I really hope someone can help me.

Having just been through the REMO procedure, a really simple procedure but made much harder due to court staff not having a clue regarding the process.

My case took 9 months and 5 days from when my order was made in the UK and payments commenced almost immediately.

If I had never done all he legwork myself I would still be waiting to this day, as the courts here told me I just have to wait indefinitely....I did'nt I took the advice of many of the posters on the very long MSE REMO thread and chased them myself. Call, email, write, whatever it takes and advise your copying to all departments.

If he moves to a non-reciprocating country, as mine said he did you will get nothing.

If he informs the csa that he has left the country the assessment will end and will not accrue arrears, therefore do not tell them yourself if he has left UK and the csa payments will accrue (that's if you find out first, I never the csa told me, which he probably had great joy in).

If you do not even know the country he is moving to you will hAve a very hard Job on your hands, they do state it is much easier if it is a country within European Union.

The problem is the csa do 'their' checks to prove they are no longer UK resident but do not check where the Nrp has moved to and believe whatever Nrp tells them! As they say they do not have the expertise or resources (what write a letter) to do so, therefore if he says he's moved to Timbukto they believe him. There's a bit of a tip for all the csa evading NRP's looking for a way out.

If you take child out of UK and you can prove that you have tried to contact him fIrst for permission, there are ways round it, especially if you have any proof he does not 'give a monkeys' a it his child and he doesn't sound like his names on BC so there'll be no Parental Responsibility.

If Nrp has any property still in the UK when he leaves you can try and keep him UK resident for CSA but if cuts all ties...does he have pensions, other children here in the UK or anyone/organisation who us making payments/correspondence with him, you know who he needs to keep in contact with? Form d85 at the county court allows a Judge to order that his CORRECT address is disclosed to the court for the REMO process after I filled out one.

    Hope this helps for now

I know this is an old thread but would appreciate some advice...

I have been trying to get CS from ex husband since 2011.

He lived in Hungary and then Germany.

I went through REMO, got a court order and sat and waited.

Due to lack of address the German courts closed the case.
They have now reopened it because I have sent them information that he has started working in Germany. He is living out of hotels so that he can't be found.

This man gave up work on purpose to go back packing around the world for a year. Staying in 5 star hotels.

Has bought a bike and a van.

Has gone on bike trips around Europe.

Flies back and forth to UK to visit family and occasionally to see daughter.

He has told my daughter.. Mum has sky TV how can she afford that if she is penniless. I have my money she has hers.

I have tried sending him the CSA list of things a child needs "How much it cost to bring up a child" but he just says I can only afford to give you £70 month.

I have never stopped access but I have stopped meeting him at the services due to a drain on my petrol.

    What else can I do?
