warning before referring for sanction?

Does your advisor have to tell you if they're passing you over to decision makers for poss sanction? Gave in my sheets, she had a quick look, said it was fine, then sent me on my way. Normally they bin the jobsearch record but she put it in my file. Could just be paranoid!

    Yes if it's to do with your jobsearch as they have to take a statement off you.

    Why do you think you will get a sanction if the advisor said it was all ok ?

    I have never known an advisor keeps claimants proof of Jobseeking, my advisor just lookes at them and he give me all of them back to me.
  • Just paranoid I guess. I met my criteria, but didn't do much above it. It was mostly how quickly she looked at it and sent me on my way, as well as keeping my logs rather than offering them back or to be recycled.

    Well they should because you should have a chance to put your reasons across. I would never refer someone across their back but not sure of the guidelines. The referral template asks for the jobseeker to give direct quotes.
  • I haven't heard anything and received a payment yesterday, so I guess it was just paranoia!

    For future reference - when my partner was sanctioned they never told him and we were told by various JCP staff (including two managers) that they do not have to tell you and that 9 times out of ten you will find out about your sanction when you check your bank account and there is no money in there.

    We received our letter re. the actual sanction some three days after our usual payment day - we went to the bank and £0.00 had been paid in...When questioned, we were then told he'd been sanctioned and the reasons for this sanction...What the JC didn't know was that 5 days previously we contacted them with a completely different enquiry and the advisor let the forth-coming sanction slip over the phone - when we pressed for more info she clammed up (at this particular point the JCP managers were telling us that there is no way the sanction would go ahead and that we've got nothing to worry about).

    Funny thing with my partners sanction is no one could work out 1. how it was even put through (since his sanction reason broke no JCP rules) and 2. why the decision makers enforced the sanction even though they had they black and white proof (was obvious the reason put through was a fabrication as the proof 100% backed up my partners version of events).

    Since you've received your payment, you can be assured you've not been sanctioned.

    But no - they are under no obligation to tell you of an impending saction, nor do you have any rights to give your version of events or a 'statement' - as we were told our defence comes when we appeal the decision - we do not have a right to 'our say' until we appeal.

    We actually put in a reconsideration - which from start to end took 11wks - mainly because the JC manager didn't put it through correctly - which meant we were sat waiting for a decision on a case that never existed outside the JC - when they realised their mistake a decision and full wipe of the sanction happened in approximately 2hrs!!!!
