OK, yet another :)

If I do this bank charges claim back thingy, I'm guessing I have to tell the OR if I get any joy, and he will grab a % of it?

It's not something I want to do before BR due to then having some money (if I get anything) and either having a small loot for the OR to query or get in trouble for paying someone or other (one or more of the creditors). Therefore it makes sense to me to do it *after* BR. As you have to inform the OR of any changes in your wages/income this will be a change, but as a one off would it prompt an IPA if one hasn't already been granted, on the basis of it could be a lot of money (then again, it could only be £20, haven't actually sat down with my statements yet, and I could get nothing at all knowing my luck), or would the OR just take a proportion of the payback in a one off payment?

    I'm sorry but if you do it after BR, the OR is entitled to the lot. :(
    In fact technically, you shouldn't even try after BR as you no longer have a legal 'right of action'.

    Just had a case on another forum where this happened, and the OR said get the bank to make out the cheque to them.

    I'm going to continue with my claims against my banks, for two reasons.
    • I don't see why the banks should get to keep the money, and
    • I'm hoping that this extra money I get to give to the OR might work in my favour when it comes to early discharge. :)

    Think I'm with Where on this one - ok I'm sort of sticking it to them by going BR, but they still have sort of contributed to BR by the charges in the first place. On the other hand, do more claims make it more likely that others that claim and will get the money (ie not BRs) be rejected - ie more people claiming mean more people's claims will fail? If so, don't want to contribute to those that will actually get their money not getting their money (if that makes any sense at all). (rhetorical question there btw :D )

    On the same vein, if you win the lottery whilst BR, I'm guessing the OR would take all of that as well then? (Not that I play, and wouldn't, but sometimes my Mother sends me a lottery ticket bless her heart). I guess I could just give it to my OH to claim if that were the case though (but then, seeing as we have yet to get a *single* number on the lottery *ever* I'm guessing this isn't about to happen lol - we are just the unluckiest people in the world methinks, should actually get a prize for not actually ever getting a number drawn :P )

    I don't know if it would work like that. I just know that if I didn't try, I'd always be wondering "what if?" especially if I don't get offered an early discharge. If I get turned down, so be it, but I'd sooner try & be turned down than not try at all. :)
