statutory sick pay - 3 days off or 3 days ill?

If someone worked part time monday wednesdays and fridays would they have to have monday wednesday and friday off before they get statutory sick pay or would they just need to be ill monday to wedneaday before they qualified

  • I think you have to have 4 days off sick to create a period of incapacity before SSP kicks in. For part time workers it all depends on which days your employer has treated as your normal qualifying days. When I did this for a lot of part time workers I treated Monday to Saturday as qualifying days for everyone as it made it easier but employers can do it differently. And you do need to earn enough to be entitled to SSP

    As has been said you need to be sick and to have done no work at all for a period of four consecutive days before SSP is considered. These can be any days for example in the case that you give of someone working Monday, Wednesday and Friday if you were sick and did no work on Saturday, Sunday, Monday and Tuesday, that would be the four days required for SSP to be considered. Then assuming that your earnings were high enough to entitle you to SSP it would be paid from the fourth qualifying day unless there was a previous linking PIW in the last eight weeks which could reduce this. You would need to check with your employer what the qualifying days are.

    This depends on what you mean by count. The first requirement for SSP is that a PIW is formed. A PIW (period of incapacity for work) is formed when an employee is sick and does no work for their employer for at least four consecutive days. These days can be any days weekdays weekends holidays bank holidays all days count for this. So for the PIW weekends do count.
    Not so simple after that though as the days of a PIW are then divided into qualifying days (QDs) and non-qualifying days (non-QDs) A QD is usually the days that you would normally work but you need to check with the employer as may not be the case. QDs will form the three waiting days and after that the days that are paid as SSP. Non-QDs cannot be waiting days nor can SSP be paid for them. though once the waiting days are served this really makes little difference to the amount of SSP that is paid as it is based on a weekly figure.
