On what you have written here it is impossible for anyone to comment constructibly on your situation.

You obviously have a grievance - fine, - your union will not represent you - so they must have a reason for this. Have you been told this reason?

Could it be that on the balance of probabilities your union thinks that you are in the wrong?
They have a duty of care to all members - which would include not wasting members money on cases where they think that they could not win.

As I have said I don't know enough about your situation and I am only thinking out aloud.

Please feel free to post more detail if you wish.

The union is advised by its solicitors on whether the case is winnable. The solicitors advice in this case would seem to be that you have a less than 50% chance of winning, as their criteria for taking a case on is no less than 50/50 I believe (though I am not certain on this). This is, as the previous poster said, so as not to waste members money on what could be frivolous cases. I'm not saying yours is such a case. There is nothing to stop you from using a no win no fee solicitor if you feel you have a case.
