my ex is remortgaging to buy me out of the property.
i am on the mortgage at the moment and also joint deeds.
what happens ? how do i come off mortgage and deeds and make sure i get my settement? will the bank who hold the deeds need us both to have solicitors as my ex says the banks solicitor will deal with all this, but i think we will have to use seperate solicitors. am i right?

if your ex is remortgaging with another bank then I would be looking for some form of deed of trust from his solicitor which promises to pay you your settlement.
If your ex is remaining with the same lender, he may be doing a transfer of equity and the deed of trust (or something similar) will be drawn up to ensure you get your share.
I would therefore get something in writing from his solicitor and then go and get it checked out with a solicitor of your choice before you sign it.I am a Mortgage AdviserYou should note that this site doesn't check my status as a Mortgage Adviser, so you need to take my word for it.
