Left High and Dry by Evenshalshaw

I completed my transaction with Evanshalshaw a branch in Plymouth ( i live in aberdeen )on Wednesday. I had purchased a car by visa electron .The deal had been agreed verbally over the phone and a deposit taken then a further payment 1 day later for the remainder of the balance.

They have now contacted me , after the money was transferred from my account to theirs and told me that there are 2 major issues as to why they have to cancel the deal.

1 : They say that they now can not take my car as part exchange as the current repair to the car is outstanding and that there may be further hidden problems which only come to light when this new part was fitted.

I had notified them that my car had 4 days ealier been into the Aberdeen Branch of Evanshalshaw and a full inspection report was available from when the car was in for inspection.
They did not raise any concerns until after the transaction was complete ,the manager of the branch even stated that they only got the full details of the vehicle 4 hours after they completed the transaction yet they had 5 days iearlier in which they could of got this report before the transaction went ahead. ... i told them that it was not my fault and that i had kept my end of the deal and they were not fulfilling theirs and that this problem was theirs to sort out. They should have been in full possesion of the facts before they went ahead and completed the transaction with me.I should not be punished for it. THEY DID NOT LISTEN TO ME

I just want to point out at this time i was in constant communication with them and had been completely open and honest in stating why we were buying a new car. We told them what the mechanic at the Aberdeen branch had told us about ours and had made a point of going into detail about the specific part that the car needed on the phone to my sales rep. They were fully aware of this before we had settled on the deal , the rep i spoke with told me that they devalaued my car sufficiently to account for this. Even after the deal and being put through this i went as far as offerering £100 max for any immediate repairs after the intial car repair was sorted. Just to complete on the deal . We are a 2 car family down to one car with a picky partner ( hence looking online and finding the right model in Plymouth)

2 : The other fact was that they quoted me transport costs from Plymouth to Aberdeen . The costs were £300 were they would pay. This was finalised at the deal. I was also told after the deal was complete that the transport costs had risen from £300 to £800 then up to £1000 , which they were now not willing to cover.
Again i told them that this was not my fault. They should have correctly calculated the transport costs before they completed the deal and took my money.

I have spoken to the top man at the branch and the regional lead and contacted their version of customer services( to which i have had no reply ) but i am still being told that they are cancelling the deal ...

I want to know ...

Can they do this ?

where do i go from here ?

How long a timespan would it take to get this sorted with them ? ( 2 car family down to 1 etc )

Many thanks for taking the time to read this.
