Hey guys
Need to know this for my own back for the Christmas period.
We are being 'forced' to take leave from 24th to the 3rd January but I have been at the company 2 months now.
I know I haven't accrued enough leave to cover this but still know about my statutory entitlement rights to a certain degree.
Should I be paid for this leave despite knowing I do not have enough due to my short time at the company currently and that I have no choice on the matter (I am on a salary if that makes a difference)

You could ask them to take it from next years allowance. I would be very wary of expecting them to pay you the extra for nothing considering you have only been there for 2 months.

No the boss literally mentioned it this week.
I have already passed my probation and they were originally had a bit of a discussion with them because they forgot about Statutory pay in the first place.0 -
Have you asked the question as to whether they will seek to reduce your pay because you have not accrued sufficient holiday?0

I started the back end of October the Holiday year runs April - March. 2.3 days a month we accrue0

2.3 * 12 is 27.6 below the statutory minimum for a 5+ day worker.
lest say you mean 28 days.(unless you also get the BH on top)
Holidays accrue from the day you start so depending when in the back end of oct it could be 22 or more weeks till end of march
say 22weeks thats 11.85 day holiday for the holiday year
They are asking you to take 9
if they don't want to pay you because you have not accrued them then that is just more holidays for next year up to end of March0 -
Probation doesn't mean alot, you can be dismissed fairly easily with no recourse in the first two years (exceptions are things such as discrimination in the eyes of the law, ie gender etc).No the boss literally mentioned it this week.

It looks like they will pay you from holiday pay in the future, if you leave before you would have accrued 9 days holiday they will claim it back from your last wage.Don't trust a forum for advice. Get proper paid advice. Any advice given should always be checked0
