Buyer refusing to send goods or refund money

Hi, I have a small business trading vinyl. I agreed a deal with a seller for some records and paid the money via paypal. When I collected the records, he said there was some missing and would forward them on. This never happened and after chasing for weeks he said he would partially refund me instead. After again chasing for weeks he told me I'm not getting the refund and he is keeping it and the records.

I have the full history of the emails and texts, his full name and address. How do I get my money back ?

    I've just realised I paid cash and not paypal.

    Its only for around £40.00. I have all the info so I'm sure I would win, but obviously don't want to do it if its going to cost me more to file the case.

    I believe the cost for filing a claim is £35, which you add to the amount of your claim. Sometimes people will pay up after receiving a Letter Before Action, which has to be sent before you start the claims procedure.

    No guarantee that even if you get judgement, you'll get your money.
    If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales

    For this amount it hardly seems worth doing, I guess I will just put this down to experience.

    If you do it though you can claim for the fee back and hopefully teach this rip off merchant a lesson!

  • Deffo small claims court. If he knows what's good for him, he will just pay up asap.
  • I would first tell him that you are going to do that and give him one last chance to pay. This will look more favourable to a judge.

    After doing this he has sent £20 fingers crossed he will send the rest.
