Recruitment Agency

Hi all, any help would be very much appreciated.

A recruitment agency found my CV online and forwarded it to a job at a college without telling me. Anyway, they called me the next day to let me know what they did and asked if I could come in and register with them, which I did 2 days later.

However, the job fell through as the college didn't agree to the agency fees, but the recruitment agent suggested I email the college direct (as I used to study there and still knew people)

I took on three days temp work that the agency had found me and then I found out I got the job at the college, but now the recruitment agency are calling the college and telling them they can't hire me unless they pay fees.

They are telling the college that they are loosing out on money from me not temping for them anymore (2 half days) and a "finders fee" if that's what it's called. Is this right since I wasn't even registered with them when they forwarded my CV? And also for the fact I still frequently speak with tutors who still work at the college?

Now my job at the college is in jeopardy. Is there anything I can do?

Thanks in advance

Ok firstly they should not have shared your info with a 3rd party but you did go in to register with them so you can not now take a job where they have supplied your CV to the employer and the employer not pay the fees. The employer knows this.

The agency has little legal standing if the college had not previously agreed to any kind of fee prior to receiving your CV.

If the agency sent out a CV for review before the contract terms were agreed (it does not appear that they have a pre-existing arrangement from what you say, then they do not have a claim, as they were not recruiting for the role.

Thanks so much for the help so far.

I called the college and they say they haven't signed anything,

Also, the position at the college is self employed. I am not sure how much difference that makes, but I'd be responsible for my own tax/NI

How did the agency get to send your CV and you have an interview if they have not entered into any contract with the agency?

The agency found my CV online. A random search of CV databases I believe.

When the recruitment agency said the job fell through, she suggested I contact the college direct (which I'd already done anyway as I still talk to tutors)

And the college replied to me saying they'd hoped to hear from me and arranged an interview with me.

Thanks again for your help. Really is appreciated

No did you have an interview at the college? You said the agency sent your CV there?

Ah, sorry, yes I did have an interview at the college. But it was not set up through the agency. As far as I was aware, a couple of days after the agency forwarded my CV, they weren't perusing with the role.

The job paid £10 per hour and the college wanted all of that to go to me, and the agency said that I'd only get £7 if they did it through the agency, so apparently the college said they didn't want to go through with the job via the agency

So who told the agency you had been for the interview if that's the case?

Ah that would, stupidly, have been me. When she told me to contact them anyway (after they weren't dealing with the college anymore) she asked me how I got on a couple of days later. In hindsight, I guess I shouldn't have said anything.

College called me and said recruitment agency were annoyed because I said I could work Friday, but since I've received the offer from the college and now can't work Friday, they'll not get the commission for my 4 hours of work and are letting down the client. As a temp, I was told I could give 24-48 hours notice if I can't work, likewise, the workplace can give me 24-48 hours notice if they don't need me. For example, today I was sent home at lunch as they weren't busy when I was told I'd get a full days work.

Anyway, I really appreciate your help, it was stressful, but honestly just felt like the recruitment agency were being awkward for the sake of £20(?) if they'd even get that, and I wouldn't be able to work at the college.

Think I'll do all my applying direct next time!
