Pay nightmare!

Hello all,

I have been having a problem with my employer. I started in January 2012 and commenced Maternity Leave on 20th May 2013. It is sales job so I receive commission for all bookings I make.
I knew my pay was wrong when I commenced Maternity Leave as I was supposed to receive commission 1 month in arrears, and only got £25 for the month of April (compared to £680 the previous month), when I made the same amount of sales and also had 2 weeks of annual leave before commencement of Maternity leave that I should have got guaranteed commission for. After calculating the shortfall, i have worked out i am £375.00 short. I have emailed HR requesting this money, along with reference numbers and figures of all of my bookings (luckily I took my diary home with all of my figures on).

What is the law on them paying me this money? I only want what I am owed, and have a feeling they will dispute it!

Any advice greatly appreciated.

Thank you!

  • If they don't agree with what you are owed then you will have to take them to a tribunal (which now can cost) or a small claims court to retrieve the money.

  • Though I would raise an official grievance through their own procedures first.

Have raised a grievance, have been told it is being investigated and they will get back to me. Do they have a certain timescale in which they have to respond?
