Hi, I have just received a letter from Arrow Global saying I owe provident personal loans £50. They say they have changed there name from Wescot SPV Ltd. They are saying that the balance is now owed to Arrow Global Accounts Management Limited and I have a 50% off fee for paying up within 30 days. They are also saying that they are now the data controller of my personal data. I do not know who these people are and the debt (I know its only £50) is not owed to them its owed to provident. I cant remember how long ago it is but I know its over 5 yrs ago as I have been with my wife for 5 yrs and not had any contact with these people. I don't want these idiots putting a mark on my credit score as I have worked hard to get it back up to standard. I no longer go into credit as I buy things outright. And all utility bills in my name are paid up in full each month.
Any advice on how to deal with this will be gratefully appreciated.

Hello there.
It's possible to assign debts from one company to another, it appears that this has happened in your case. All that is needed as far as you are concerned is for the new company to provide you with notice of the assignment.
If they are to process your personal data they should update any existing default (if there is one) with their own name. A debt can not have more than one default registered against it.
Can you remember when you last made a payment in relation to this debt? Can you also remember if you have ever written to anyone about it?

Hi,
I last paid a long time ago, its been a good 6 years since I paid any amount. And I have never written to anyone about this. I would like to know where they got my address from as well. Not happy about it as you can imagine. I know its only £50 and I could pay it one go no problem but I have heard a lot about companies trying to enforce statute barred debts. I don't want to contact them as that's an admission of the debt. I did Experian credit check a couple of years ago and there was nothing coming up on there. I had good credit according to that.0 -
If you are sure the debt is statute barred you could send them the following letter as it would place the burden of proof on to them:(Your home address)To:

You have contacted me/us regarding the account with the above reference number, which you claim is owed by myself/ourselves.
I/we would point out that under the Limitation Act 1980 Section 5:
“An action founded on simple contract shall not be brought after the expiration of six years from the date on which the cause of action accrued.”
I/we would point out that in their Debt Collection Guidance, the OFT regard the following unfair or improper business practice for a creditor to:- pursue the debt under circumstances in which the debtor has heard nothing from a creditor during the relevant limitation period.
- continue to press a debtor for payment after he has stated that he will not be paying a debt because it is statute barred.
I/we await your written confirmation that no further contact will be made concerning the above account and that this matter is now closed.

I will send that letter thank you. If it isn't statute barred (ie 5 yrs instead of 6) then I shall just pay it.
Quite annoyed though that after all this time they are coming after me for it.

Had exactly the same letter on Friday as well. Same creditor as in Provident.
Haven't had any dealings with anyone about this for well over 6 years. They will be getting a statute barred letter ASAP.
Looks like they are buying up old statute bared debts in the hope that they will be successful in collecting something.0 -
A couple of points - that standard letter is not for use if you are in Scotland, where there is a 5-year rule. The full suite of letters is here:

Do check your credit file. Arrow Global are buying a lot of old debts and I se them frequently on credit reports that I have to check before I submit a DRO application. They should not introduce a new default.0
