hi all asking for a friend
she has a child who is 9, father left mid pregnancy, he started paying csa around 7 years ago
she recently asked for a review which has come back at half the amount it was, she wants to try to prove that he is lying, he is self employed and there is now way that his declared income is right
the same scenario came about 7 years ago she submitted evidence but after years and years she gave up but this time she is going to fight all the way
last time she paid for and submitted land registry forms that proved he owned 2 houses, 1 that his parents lived in and 1 that his ex wife lived in, she also sent information on his website about his business and how much he charged for his services, also expensive cars that he owned
is there anything else that she could look at obtaining that would help?

Has she requested a variation to take dividend income into account? If not she should do that straight away. I am assuming she is not yet on the new scheme so it may be worth her applying for a variation on lifestyle inconsistent with declared income, but she should be aware that the new scheme does not allow for a variation on those grounds (and we will all move to that scheme fairly soon).0

If he's self employed it would be a Variation for diversion of Income or Lifestyle inconsistent - he won't receive Dividends - she can also apply on the grounds of Assets. It is likely that the application will fail and she will need to progress an appeal to gain any satisfaction.0

If he has his own limited company he will most likely receive dividends, many people refer to this as self employed because the subtle difference that he is employed by his company is not obvious to most people. The PWC should request a variation to have any dividend income taken into account, unless she is sure that he doesn't get dividends. She can do this as well as asking for the variation for lifestyle inconsistent.0 -
I have just had this with my ex husband who is self employed. You just ask for dividends to be taken into account, it's not complicated you can ask over the phone.
Anyway, I asked - they contacted HMRC - got the dividends and problem sorted. Obviously they used last years figures not this years which haven't come through yet.

If your ex receives dividends he is not self employed - he's employed by the Ltd company.0
