Hi everyone' trying to help my son who is suffering depression after his daughters death. He has a company hounding him called marstons high court enforcement officers. It is for a debt he had with an insurance company . His ex cancelled his insurance and didn't tell him they then took the payment off her credit card which she was'nt happy about but it appears she got the money back that's why they are pusuing my son now. The debt has risen alot and they are threatening baliffs. He is not coping too well and on top of that he's self employed with no work on the books. He has no assets and is staying on our sofa, also a daughter to support.
My question is when the bailiffs come can they take any of our things ? As he lives at our address and also do you think these companies are open to negotiation for repayment
Your thoughts appreciated and thankyou

No they can't take your stuff, debt is linked to a person, not an address. As long as you don't have any joint financial accounts with your son, it won't affect you.
The worst thing your son can do is stick his head in the sand over this. Tell him to write to them and tell them he will be paying token payments of £1 a week. Also get him to visit the CAB who will be able to advise him further0 -

Hi lynnellen
I'm sorry to hear about your son's difficulties.
I echo what 19lottie82 has said above - it is your son alone who can be pursued for this debt. Whether the company is "open to negotiation" remains to be seen but in a way that is beside the point - your son can only offer what he can offer.
It's not entirely clear in what capacity Marston are acting here, which makes it a little harder to advise on their exact powers. Has your son received any other correspondence like court papers that might shed some light?
Even if Marston are enforcing a court warrant for this debt, they won't be able to force entry, so things are not necessarily as urgent as they could be.
Kind regards

Thanyou for the responces
The letter says they are in possession of a court order and demand full payment immediately. I know these companies use scare tactics and I just wondered if anyone had heard of this company or had dealings with them.
I am trying to get my son to deal with the situation as I know its the only way to get it sorted as I can no longer offer anymore money myself as I have already cleared certain other financial problems.0
