ESA fit note problem

A fit note for 6 months dated 9 September was sent to Jobcentre plus. A ESA50 was sent to be filled in a month later, and returned within 2 days.

A letter has just been received saying that 'fit note expires on 8 December' (it was for SIX months, not three).

Phoned JSP, they say sick note can only be for 3 months.

GP is refusing to issue another as he has already issued one for 6 months, and it is a condition suffered from birth he could write a note out for any length of time, up to indefinitely.

JSP say they are stopping benefit if they do not receive another fit note (even though they have a valid one).

What do I do?

  • In the first six months of the claim, the fit note can cover a maximum of three months. Ask your GP to refer to their guidance notes, this will be confirmed in there.
