Hate to play devils advocate but.....

The loud and irregular noise could just be the disc drive, 360's are noisy and that is just normal.

Not sure why people are quoting SOGA at you, AFAIK the machine works although it looks a little poor. Its not grounds for a refund under SOGA but at least you know to inspect things in the future.

I think you're just going to have to go back and kick up a big fuss TBH sorry.

But if the console was meant to be 'refurbished' and it is not showing signs of any refurbishment, then it is 'not as described' and hence the SOGA comes into it.

A chewed controller cannot be considerd 'refurbished' in most peoples normal understanding of the term.

I can assure you, consoles at the likes of Game are not 'refurbished'. They are taken in pre-owned and put straight on the shelf for sale. They do not go through a 'refurbishment' process - that is plain to see in a lot of cases. THey may wipe the hard disk, but that is all - and that is only for Data Protection purposes.

As suggested, go back, on a Saturday afternoon (nice and busy just before Xmas) and make the biggest fuss you can - politely, but firmly. They will not want THAT sort of advertisment in store, so should deal with it to make you 'go away'

The OP bought goods that he has subsequently decided he doesn't like the look of although states it works fine.

He has stated he had the opportunity to inspect/view the console before it was boxed. He could have declined then if he wished, if his view was not good enough rather than jumping in with 2 feet.

Reading back his transcript of the chat with online help he lies and claims he wasn't even shown the console, but the operator does confirm if it doesn't work he's entitled to a refund.

I think he needs to take some responsibility for his actions, he's bought something in haste then changed his mind. SOGA still does not apply.

Quite agree, I have done this and got the same results!
    You live..You learn.:)
  • There is no customer service in Game
  • If you are unhappy with goods you are within your rights to return it, sticker breach or not. I have done so plenty of times with GAME.

If it is a Xbox 360 slim it should not be making that amount of noise.
