Signed Contract not being given hours

Hi MSE's :hello:

Basically i signed a contract on the 22nd for 30 hours a week with my new job. The problem is I've not been rota'd in even when I ask. They are shuffling new staff. So I got a call yesterday and the boss said he can not fit me in the rota this week.

I of course objected and said we signed a contract and I need my hours as he is now my sole employer. He said his sorry he will pay me for my one day I have worked and I won't have any shifts for at least another 10+ days. He gave no other option and the contract didn't mean much he said he shouldn't have signed me for another 2 weeks.

Point is now I'm left with no income. No money for christmas and none to last me through till next pay. (January 30th).

I really don't want to cause a fuss as I'm in my first week and a probationary period. On the other hand i dont want to be mucked around and broke. Surely he has to pay as I have a contract?

    Unfortunately they doesn't have to pay you if you have not worked, and they don't have to give you work if they don't want to. If you kick up a fuss they will just sack you.

    So the 30 hour contract is not worth anything? Thought thats a legal document to ensure i get the hours and therefore pay? :)

    Your employer can terminate your contract for whatever reason they wish provided it not discriminatory in the first two years.

    I know you have only just stated but I would be looking for another job asap as this employer looks like they might be a nightmare.

    This i believe isn't true, if htere is a signed contract then the OP is legally entitled to pay for those hours.

    As mentioned though, you can be let go of in the first two years for pretty much nothing except standing up for statutory rights and discriminatory reasons in the eyes of the law

  • Depending on the job it might be worth hanging on to see if he is going to honour your contract in the next couple of weeks - as well as looking for another job. Whilst you are correct, you have a contract, your employer could deal with this by just dismissing you. If you have worked under 16 hours I think you could sign on at the job centre and explain that you are waiting to be offered the hours.

    You would have to make a claim via the tribunal or small claims but do expect the job to end as soon as you go down this route.
    Don't trust a forum for advice. Get proper paid advice. Any advice given should always be checked
