Company Bonus Structure

Can anyone kindly give me advise, my company set my yearly bonus structure target l reached this target and exceeded by £1500. I have now been advised that they will have to add a further £6000 to my targets for overheads which puts me under my target. When l was set my target in Nov 2012 there was no mention either verbally or in my written targets.
It does state they can amend my target with 30 days notice but my year is up now and l have never received any notification. Can they legally just change goal posts to suit them so they dont have to pay me my bonus owed.

    Don't trust a forum for advice. Get proper paid advice. Any advice given should always be checked

    Or even "contractual"? Because if a scheme isn't contractual you can't hold them to anything.

    And much as I hate to say this - if it is not discretionary, and is contractual - are you willing to sue your employer for your bonus? Because if you have less than two years employment, I foresee your dismissal looming. And if you do, I see your redundancy looming. It's not an employees world these days....

    The letter states discretionary bonus plan, l have been employed with them for 5 years, this is the first time they have stated this.
  • If it is discretionary, then they can pay it or not as they decide. And I don't wish to be awkward, but I would lay bets it isn't the first time they mentioned it - I would lay bets it is the first time you noticed that somewhere in the small print it says "discretionary". Nobody ever looks at what it says if they are getting it (which I assume you were previously) - they only look when they don't get it.

    Company Bonus schemes are a complex work of smoke and mirrors in my experience the schemes are designed to offer a decent carrot but then nibble that carrot away under the guise of some HR/finance related guff.


    Its such bad practice, it generates much bad feeling and prompts good staff to leave.


    It is especially common in sales, where usually the first year the bonus is fair, then after that they stiff you for all or part of your bonus.

    when a bonus is paid, it creates a great feeling and ensures dedicated staff not only stay, but work for the good of the whole company and not only their individual commission payments.

    commission payments are contractual, bonus payments are, by definition, a bonus.

    Many thanks for all your advice and sorry for delay getting back to you. The letter received with annual target structure states commission but the rules state Group Bonus Rules. It is over £9000 as its paid yearly and lot of money to me what l have worked so hard to achieve:mad:.
