Hi all, Am hoping for some answers from people with a better wealth of knowledge than myself on the matter.
I was declared bankrupt in Dec2008, and was subsequently discharged early in June 2009. It was personal debt, no house or estate to be taken into consideration.
Now there are positions available for school governers at my children's school for which I would like to apply. However, the crieria says you cannot hold such a position if you are subject to a bankruptcy restriction order, an interim bankruptcy restriction order, a debt relief restriction order or an interim debt relief restriction order. Has had his/her estate sequestrated and the sequestration has not been discharged, annuled or reduced. (and other things but I am not restricted from working with children or been in prison so not applicable!)
To me it sounds like as I have been discharged then it would be OK, but I am not 100% sure and wondered if anyone knows? Any advice would be greatly appreciated! Many thanks. ( PS I don't even know what 'sequestrated' means.....might have to dig out the dictionary!)

Hello there.
So long as you have been discharged you are OK to apply.
Sequestration is the Scottish term for bankruptcy - although they generally use 'bankruptcy' more these days!

Looks like I will be ok to put myself forward then. Do you happen to know if they will find out about the bankruptcy if they do a check on you? Not that it matters, as if being discharged means I am eligable, but at least I will know what to expect if they ask questions, and can give them the right answers. Presumably any checks done are confidential anyway?0 -
Don't know if they would find out about it anyway, or if you would have to declare it anyway, but I'd be tempted to ask them before you apply. Ultimately, I believe, it is up to the head teacher.0

You won't be on the Insolvency Register any longer, but the historical record of the bankruptcy will remain in the London Gazette archive indefinitely.
I wouldn't worry though - it's only an undischarged bankrupt that can't be a school governor.0
