Vehicle Question

Hi, about to go bankrupt with my OH but have issues regarding a vehicle.
In April whilst in hospital the van that I use to daily to commute to and from work blew the engine, my mum offered to purchase another one for me until we could afford to buy our own, I work fulltime and my OH is long term sick (he has a mobility car) so I need a vehicle. The van is a dual purpose vehicle as my mum uses a mobility scooter and I can use it to get her out and about.
The problem is that I have had conflicting information with regards ownership as my husbands name is on the V5 as he went to collect the van but the receipt is in my mums name and she withdrew almost half the cash out of her bank account on the day of purchase and the rest she had at home in savings, I would be devastated if they classed it as my OH asset and it would cause untold problems with my other family members. My mum paid £1200 for the van but its probably worth a bit more as it was bought without tax/mot as it had been stood for some time.
The insurance is in my name with my other half as a named driver so he could collect the vehicle. It was from a private seller.
Sorry to waffle but extremely stressed at the moment.
Would be grateful for any info

Hello there.
If your mother can prove she paid for the vehicle then it should be OK. The registration document does not always show who the legal owner of the vehicle is. The official receiver will require proof, and from what you've written it appears that you will have it.
You can read more information about this via the Insolvency Service's own guide here:

Hope you find this information useful, if you have further questions please ask.

Thank you for your reply, as previously stated my mum does have a receipt from the seller which is a hand written one as it was a private sale, it states her name, date, vehicle reg, sum paid and also his name , address and signature and she also has a £500 cash withdrawal from her bank account, the rest was her savings from home.
Just hoping this is proof enough for the OR as I know the rest of the family will pressure her into asking for the van back rather than my mum losing that much money. Cant blame them really but I would then really struggle getting to and from work.0 -
Given what you've said, and based upon similar situations with other clients we have helped in the past, I think you'll be OK. The OR will need tangible proof (which you have). The guide is worth reading although it is a bit wordy in places.
Best wishes,

Thank you David, you have been a real gem and have helped to ease my mind, still a little unsure though but probably just the situation as a whole,
Was really worried as the vehicle was purchased from a private seller rather than a garage because of the receipt being hand written as apposed to being on letter headed paper but quite sure it would be easy to compare the sellers signature to that held by DVLA for him.
Thanks again much appreciated.0
