Need some legal advice please.

Hi all, i'm after some advice really about the following:-
Last month I purchased a complete bathroom suite by my visa debit card, On day of delivery the items never turned up. After many phone calls where I got nowhere I turned up at the shop to find it had gone bust.
Since then I have had to purchase another complete bathroom set from elsewhere which i'm in the process of getting this installed. Now I have got in contact with the liquidators to try and claim my money back, and also i'm trying to claim money back via my bank through the 'charge back process'.
Now yesterday the manager of the store tried to contact me stating the shop was going to open again this Friday and to call about my bathroom suite. Now I can give him a call, but I know he isn't going to give me my money back.
Obviously I don't want another bathroom suite I want my money back.
What are my rights regarding this and what are the chances of getting my money back?

If it's a debit card legally your chances are slim.
By all means pursue your bank - ask them to try a chargeback - if you succeed great but it will be at your bank's discretion.
Do you know for a fact that the shop has gone bust?
Is it just hearsay or have you been informed perhaps by a liquidator etc?
If it did go bust then IMO (IANAL) you have no contract with the 'new' shop only the old one. This is particulary true if is was a limited company.
If in the end you do not get your money back through your bank or the shop then if you are offered a bathroom suite I would take it - at least then you can recover some of your money back by selling it.0 -

Strange that the manager has contacted you - I would certainly call on Friday and see what sort of offer is on the table! (And do let us know.......)

Yeah the Manager left a message and even stated that the company had gone bust, but will be re-opening.
I found out the company had gone bust on the date of delivery as some one had told me when I turned up to the shop. Also I have spoke with the recievers about this.
As far as i'm concerned the goods weren't delivered so they are in breach of the contract and I have sent a letter to the company secretary explaining this fact.

No use to original poster, but a reminder or lesson to anyone else - it's always wise to put this sort of expensive purchase on a credit card, not a debit card, so that you have some comeback. Good luck with it.0
