I agree with Lincroft - if the council decline to award the SPD then you will be required to pay the full balance until such time as the tribunal have heard the case and made a decision.
If payment isn't made then the council can proceed with recovery action - even if you were later awarded a discount the action would stand.I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.0 -
Very helpful thanks. I am unlikely to proceed though I am sure that I am being treated unfairly. I would not perform well under stress in court.
Its more like a business presentation meeting than a court.
I didn't find it stressful.
If you feel you have a case then it is your right to have your appeal heard. You don't need to be slick. Just answer the questions and state your evidence. Nothing bad can happen. Even if you lose you will just have to abide by whatever it is the council are demanding.~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~

At no time have I threatened to suspend my full payment. I have only requested the adjustment. I have never missed a payment and have always informed the council promptly if a new lodger has moved in. There is no reason for them to be suspicious. My lodger has now said that he will give me his new address.0
