Clever people needed! My situation

Hello!

I am hoping someone can give me some guidance on a problem I have!

Back in October last year I joined a contract with JJB Gym for £35 a month. It is a 6 month contract, however if you have a good reason they can cancel your membership within this period (several people I know have done this).

Anyway, my problem is back in November I had a problem which means I couldn't afford the gym membership for either myself or my girlfriend. I went into the branch for advise, they seemed pretty clueless but told me if I wrote a letter in that would be okay. I wrote a letter to the address I had on my initial documentation from them, and awaited a reply.

Several weeks later I had heard nothing and so cancelled the direct debits (mine and my gf) with the bank. I assumed if there was a problem they would write, however I received no correspondence so my friend who was still a member discussed my situation with a member of staff who said it would be OK and they would write to me if I owed them any money. I obviously did not use the gym since last... November (before I cancelled DD) and assumed it was over.

However, several weeks ago I found out my account is still active and on their system we have both accumulated a 'debt' for the last... 7 months? I phoned and confirmed this and was told 'yep your membership is still active you just need to come in and pay £XXX'.

Needless to say I was gob smacked, the guy didn't know how to help he said I'd have to speak to head office. I am now too scared to contact them in case they tell me I need to pay them several hundred pounds within the next month. I don't know what to do and if I can legally refuse to pay this, or if they hold the upper hand.

Any ideas?

    Get something in writing from the branch staff confirming their understanding of the situation.

    when you go to the jjb for a work out do you have to sign in? I know you do with most gyms, if so here is you proof you haven used it.

    That is a start

    also have you got a copy of the letter you sent them? what about a postal receipt?
