Received a letter from PE on 13th Nov as the registered keeper of a vehicle that on 3rd Nov exceeded the time limit in a private car park covered by ANPR.
A ticket was purchased for 4hrs, but the vehicle exceeded the time by 51 minutes (a genuine error)
The letter states £100 or £60 if paid by 21st Nov (note the letter has a date of issue as 7th Nov, but not received by me until 13th)
The 'charge' of £100 seems rather excessive for a 51 min excess stay when the charge for 4hrs was £3.00.
Also the ticket was purchased at 2105hrs and the car park was deserted when the car arrived and left (not a particularly popular location and more daytime use)
The ignore advice appears to be no longer valid so planning to appeal to PE directly in the first instance. Is the most recent appeal wording available and is it worth it.
Also, is there any breach of codes etc by delaying the sending of this 'penalty charge notice'. Hardly seems right that they can print the letter on 7th and not deliver it until 13th and count that as part of the time when earlier payment can be made.

It's not a 'penalty charge notice' though is it? Tis a parking charge notice. And who CARES about the 'earlier' charge, you won't be PAYING this?!!Is the most recent appeal wording available and is it worth it
Yes, the appeal examples for this stage are linked on the 'newbies...read this now!' sticky thread at the top of the forum, and yes it's worth it as it costs PE money for POPLA only to lose, as we beat them every time right now with certain wording. If you ignore, then PE are suing people who do that...so appealing is certainly worth it.
So is complaining to the Retail Store Manager or Centre Manager. Assertively and angrily, as per the examples and info in another sticky thread at the top, called 'successful complaints about PPCs'.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thanks for the advice. I put together a comprehensive appeal to Popla using the template guidance and was notified that my appeal would be heard on or after 6th Feb. That date came and went and I received nothing from Parking Eye or Popla.
On 26th February I received the following by e-mail from Popla:
The Operator issued parking charge notice number XXXXX/XXXXXX arising out of a presence on private land, of a vehicle with registration mark XXXXXX. The Appellant appealed against liability for the parking charge. The Assessor has considered the evidence of both parties and has determined that the appeal be allowed. The Assessor’s reasons are as set out. The Operator should now cancel the parking charge notice forthwith. Reasons for the Assessor’s Determination. It is the Appellant’s case that the parking charge notice was issued incorrectly. The Operator has not produced a copy of the parking charge notice, nor any evidence to show a breach of the conditions of parking occurred, nor any evidence that shows what the conditions of parking, in fact, were. Accordingly I have no option but to allow the appeal. Shehla Pirwany Assessor
Looks like Popla gave Parking Eye more than enough time to respond, but they didn't. I have complained to BPA separately about Parking Eye breaching the Popla Code in a number of areas but unsurprisingly this was rejected. Parking Eye are free to continue their substandard practices knowing that the BPA won't investigate any complaints and it would appear from my case that they just didn't bother (maybe they knew the extra work providing the evidence I requested was not going to cut it) responding.
Charge has now been cancelled and cost Parking Eye far more than the 42p charge that my vehicle would have incurred on the basis of their rates for the car park.0 -
