JSA stopped for misconduct!! Hardship Payment?

Hi All
Can someone give some advice
My partner has received a letter today stating his JSA is being stopped from 2/11/13 to 29/01/13 because of misconduct. (he's already had a payment this month, will he have to pay it back). He first signed on in Sept after his company he was working for went into liquidation. He was only claiming for 3 or 4 weeks before he got a job offer, he started a months probation. One Friday about 3 weeks in, he was called into the office and was told that they were not going to take him on as they had received an email from a client saying they were not happy with his work (driver) apparently while the lorry was being loaded he was talking to someone. He's not aloud to help load the vehicle. He was also seen parked outside a house when he should of been on his way o the depot. He had no meeting to discuss any of this, and was just told thats it. The house was our house and he was using the toilet! Also he found out that an old employee had popped into the family run business that morning looking for some work, he is now doing what my otherhalf is doing! The form which the DWP sent to his old employer states that he was let go because of misconduct but then states in the comments box he left for no reason! We have wrote to DWP to appeal to the decision..... I am currently on Maternity leave and I've just completed all the benefit paperwork with JSA as an income, do I have to do them all again for the period we don't have the JSA coming in! Anyone know what the hardship payment is? Also for his first wage we didn't get a wageslip is it worth me chasing it up. Sorry for the essay

Sorry to hear this, A hardship payment is less then JSA and you will get around £65.70 a fortnight until he's sanction ends.
I know it's not much then Jobseekers but it will help in the meantime and it could also take 4 weeks to reach your bank account but not sure on that one.0 -
Sorry OP but to drive a lorry home to use the toilet when he was supposed to be on his way back to the depot is unacceptable.
I doubt the client told them that he was parked outside of a house.It's better to regret something I did do than to regret something that I didn’t. :EasterBun0
