    In answer to your questions guys:
    - my wife is claiming all she's entitled to (Although were about to go head to head with ATOS :D Who will no doubt claim that my morphine dosed wheelchair based wife who sleeps 16hrs a day is able to work as a fitness instructor. I'll keep you posted!

    I've read the links and on the advice given I'm thinking that the no signature / no contract argument may be a lot of work for likely no benefit :( I'm thinking a final letter of complaint to SimplyNo with a direct threat of FOM, and then when they say no (a certainty) then I'll fire it off to the FOM.

    Can I cite the 2 FOM cases in the letter to SimplyNo or even the impending FOM Letter do you think?
  • I would just tell them you await their final response and if they won't help you by freezing interest you will be referring to FOS where you believe similar cases have been upheld.

    The thought of the FOS referral fee alone may make them see sense.
