Arrears letter 5yrs after discharge

Hi, I've been discharged since jan 2009 and it's been mostly smooth running with the old creditors being good about the bankruptcy.

The exception is Santander. They won't go away. The original debt was with Alliance & Leicester which I assume was then taken over by Santander. Santander then sent arrears statement every six months and then passed on my details to a collection agency. The collection agency stopped contacting me after I emailed them a copy of my bankruptcy.

Santander keep on sending the statements and are awkward to contact. Can anyone suggest a way of getting them to stop contacting my and to recognise that the debt is no longer there?

Thanks

I had a problem similar however I was getting bills and debt collectors letters for someone who doesnt live at my address.

One of the debt collector letters even said "we have done our checks and can confirm you live that this address" even though I have lived here for near 6 months.

I complained to the company and they said the debt collector letters will stop but they cant stop their own letters being sent as the computer will automatically send them for any debt owed.

I explained it is only wasting their time and postage fees and if it wont be stopped I will send letters requesting it to be stopped again and each letter will come with a £25 admin fee and if they didnt pay I would send them debt collectors letters.....funnily enough after that conversation they stopped....

You have been BR, you are discharged and they are now harrassing you, tell them to stop or you will invoice them for every letter they send.

    Hi there

You could make a formal complaint and then escalate it to the Financial Ombudsman (FOS) if necessary. It's not an overnight fix but once you make them aware that this is a black and white matter, the fact that they will be billed for the FOS inquiry might finally bring them to their senses.

  • Thanks for the replies. I'll write a formal complaint and see if I get a response.

Hopefully I'll be able to report back with good news.

    Good idea Dennis.

An e-mail to customerservices@santander.co.uk will suffice. It the OP does that tonight (or any time up to close of business on Friday) then they will have until 17 January to sort it out. If the OP sends it at tea time tomorrow, Santander gets until 20 January.

Just keep a copy of the e-mail so you can prove when it was sent if FOS need you to.
