Accident forces resignation

Hello all, I hope you can help as my brother could do with some advise.
My brother works for a window fitting company, they are expect to carry huge heavy windows by themselves up flats, apartments etc. not the greatest thing to do and not very safe. Anyway a few weeks ago he had an accident at work. Im not sure of the complete story but basically he had huge wooden oak windows with the glass land on his head without him realising. It was works fault and it was something to do with the way they are secured on the van or the way they have been taught to place them and store them which was unsafe. Anyway lucky he was wearing his hard hat but it did knock him out for a good minute.
The results have left him with severe pain in his neck and upper back which he is having physio for. After much persuasion from me he has put a claim in which is in process, he hasn’t said anything to work but im sure they know. Anyway he had gone back to the Monday after, this happened on the Thursday before so only a few days. He had said that his neck was still sure and could they put him on light goods. They did this for one day and then it was back to normal. He did say something but his supervisor had just said to grow a pain and get on with it. The way my brother is which is someone who will just do as hes told and not to cause any trouble so he just carried on. Hes been really struggling and with the job he only gets paid for 8 hours work but they will leave at 6am and most days are not back until 7pm, they work all over the place.
Anyway its now got to the point and after a 14 hour shift Monday that he can’t continue to do this job, has signed him self off but has already been offered his old job back which he enjoyed.
He needs some time off to recover a bit anyway so ive told him to go to the doctors and to be properly signed off for a week or 2. This way he can work his notice on sick and start his new job after.
I just wanted to check if this seems ok for him to do and hoping you can help.
The second part of this is with his claim hes obviously injured but personally my brother is an amateur boxer, its taken him some years to get to where he is and now he is in the amateur national championships so he has still been fighting, even tho really struggling he has had 3-4 fights since the accident and has been winning. He feels that he shouldn’t fight but its for national championships so hes not going to not fight. For him it’s a big thing as in the last few years hes gone from 20 stone down to less than 9 stone through boxing. Also hes considering in going professional. The issue is can they throw this back at him with this claim saying you cant work but you can box. He knows he cant do either at the moment but hes not missing this chance as hes now in the semi finals. 2 more fights and that’s it this year.

Lol@can they use this against him. He can box which is more physically demanding than lifting some windows but he's so unwell he can't work. Expect people to accuse him of lying, even with a doctor's note. And no he can't claim. How do we know he was really injured from 'accident' at work? Could he not be injured from his boxing games?0

20 stone to 9 stone? How tall is he?

It's also easier to link a bad neck and upper back to boxing than glass falling on top of his head which mysteriously caused enough brain damage to affect his neck and upper back.
The doctor signed him off sick because he's not aware he does boxing. Expect the employer to claim back the sick pay.0 -

How on earth did he pass pre-bout medicals? Did he 'forget' to tell the doctor he'd been knocked unconscious at work?On the day of your bout you will need to attend a weigh-in with the Official in Charge, before going to see the doctor for a medical to ensure that you are fit and well enough to compete. Both of these processes are in place to ensure the safety of the boxer and that the bout is fair.
So ............ either Michael Jephcott's ABA doctor is at fault, or Jephcott didn't mention his loss of consciousness to the doctor. If the latter, his license will be taken away from him..................

f you're going to box whilst making a personal injury claim, it's probably best not to put it in the local paper. I would expect the insurers to report this to the police and have him done for fraud.0 -

Ahahahahahahaha! You've found him already. Employer's lawyers will probably do a quick check and find this too. Any claim is stabbing yourself in the foot and asking to be jailed for fraud. :rotfl:0 -

hello all, maybe its the way i explained this.
so he has an accident at work, as mentioned im not sure of the full details but they were on a job and he had his back turned and some huge windows with triple glazing fell off the truck and hit him on the head and knocked him out.
he was completely fit untill that day. ever since he has really struggled, its affected his work and his training.
as mentioned with what he has done with the weight loss etc and how far hes got with this he didnt want to not continue with the championships.
its now apparent that hes struggliing with his work and the lifting and the boxing also.
he hasnt had an sick days apart from being signed off yesterday. he has worked all the way through so please dont think hes been off sick and boxing.
anyway he has now decided that the job is physically to much for him now due to the strain on his neck so has decided to resign.
basically hes put in the claim due to unsafe proceedures his work has. before he was fit and healthy and now hes not thats it.
as a result it means he cant continue this very manual heavy lifting job and also its also affected his training and boxing career.
Fraud is radiculas. i hope you understand what i meant.0
