debt help
I just wanted to find out if a creditor can request your bank statement and require you to get a mental health form filled in with senstive information from a gp or psychiatrist. If you want to set up a payment plan with them. I suffer from mental helth problems had a relapae and madw some terrible financial decisions. Which includes multiple payday loans. How ever they all have accepted my plan except mr lender they need me to fill in a form with my mental health details. And cfo lending have requested my bank statements. Can they do this.

Hello there.
You should challenge the creditors, they really should not be asking for your bank details. Generally speaking they should consider a reasonable offer of payment backed up by a comprehensive financial statement. If they state that they will only consider an offer if supported by your bank statements you should consider a formal complaint.
Although you do not have to send information in relation to your health it could be useful to provide it. The reason being is that there are guidelines which place an obligation on creditors which outline how they should help people with mental health difficulties. They can ask, but you are under no legal requirement to provide it.
However, they are also under no legal requirement to accept any particular proposal of yours. It sounds as though they may be helping you out by offering you favuorable terms, as you've been unwell. If so they will of course want to see proof of your illness before signing up to the deal.
In effect, if you say "can I pay less back, as I've been ill", they are replying "OK, can do, can we please just make sure that you really hae been".0 -
Thank you very much. This has been helpful information. I must say how ever that I did send them a supporting letter from the agency thats supporting me at present. On headed paper with information to contact them. So I cant see why they need me to fill in another form listing and explaning the extent of my mental health problems. My psychiatrist has refused to send them this information.0
