I paid CSA up until the day I departed the U.K for Canada.
Before this period I had appeals, tribunals ect. Reason being social services were involved my ex was continually leaving my child at home alone whilst partying with my money , paying for her and friends to have limo rides etc. my child always asked me to pay as my ex said she couldn't buy anything as I do not pay (untrue). My child came to live with me for 3 months as she had enough of the police raids drugs etc (I should add social services kept saying we will trying our best to keep your child with the mother its the best place for kids blah blah) my ex didn't pay a penny in CSA and told my child she would commit suicide if my child didn't return. take a guess..... After she returned the school started reporting her to ss for lack of uniform, cold chips for lunch etc (baring in mind CSA chased me for payment the moment my child returned).
I continue to put the money away each month but I refuse to pay my ex so she can go back to her partying ways unless she is amicable (since I have stopped paying she is calmed down entirely). She still will not sign our divorce out of spite (no assests)
I am potentially planning a visit to the U.K for 2 weeks. I would like to see my child and I would like to sit down with my ex try and be amicable and I will start to pay her direct.
Can anyone give me advice on how to approach this? Do CSA have any rights while I am back for a short trip to arrest me or anything!!? I understand I do not accumulate arrears while out of the country is this true? I ask as I could put this to my ex stating she is only cutting her nose of to spite her face . The money I am putting away I will give to my child when older
Thanks in advance. I wish people could just be amicable its so unnecessary when I am willing to pay I just want it going on my child!

They can only arrest you on returning to the country if there was a warrant already in place for your arrest for failure to pay child maintenance. That would have involved obtaining a liability order and a whole lot of other court dates and other enforcement actions before asking a judge for your committal to prison. You would have been served notice in all instances, so long as the CSA had your correct address (unless they made some huge mistakes by sending all correspondence to an out of date address). If you were up to date with you payments when you left the country and provided them with evidence you had left permanently so they could close the case, then you shouldn't owe any arrears right? If you don't know, they only way you can find out is to ask the CSA and do what needs to be done to resolve the situation.
On a side note, Canada is one of the countries signed up to REMO - reciprocal enforcement of maintenance orders. This means your ex could now apply to a UK court for a child maintenance order and then under REMO have payment of it enforced by the Canadian courts. You may want to look into that do you are prepared.I often use a tablet to post, so sometimes my posts will have random letters inserted, or entirely the wrong word if autocorrect is trying to wind me up. Hopefully you'll still know what I mean.0
