Welcome finance issues!

Hi there, several years ago, (approximately 5-6) I took out a loan with welcome finance for a new car. I moved down to Devon nearly 3 years ago and Lewis group got in touch to say there was still an outstanding debt with welcome. I set up a monthly payment plan and everything was going fine. Then I received a text message from Lewis group saying the account had been returned and no further action would be taken. Fast forward to about a month ago and IND got in touch saying they were taking me to court on behalf of welcome. I spoke to welcome and asked why Lewis group told me it had been dropped and they said they had nothing on file to say it had been. I just got off the phone with Lewis group and asked what happened and welcome DID ask for the account back. Why would they do this if I was paying what was agreed? I now have a ccj against me because of this. Fingers crossed there's a company trying to get ppi back for me but I'm not holding my breath. Can anyone please advise me on what's happening?

    You defaulted on your Welcome account, they sold it on but than took it back again. They are now chasing you for the remainder (what was in the CCJ).
    A text message will be of no use, if it isn't in writing, it didn't happen.

    You are being fleeced by these PPI vultures, all it took was one letter and you would have received a full refund plus 8% interest. the PPI company will be taking a large chunk for themselves (all they did was fill out the same form you could have done).
    How to make a claim for compensation

    The FSCS will be making arrangements to contact all policyholders who were sold PPI by WFSL on or after 14 January 2005, and will work as quickly as possible to process any claims received.
    If you do not want to wait for an application form to be sent to you, you should contact WFSL’s customer services team on 0845 373 0386 or write to them at Welcome Finance, P O Box 10950, Sandringham House, Harlow, CM20 9JF. Alternatively, you can contact the FSCS customer services team on 0800 678 1100 or 0207 741 4100 to ask for an application form to be sent to you to make a claim for compensation.
    If you have previously submitted a complaint to WFSL relating to a PPI policy that was sold to you on or after 14 January 2005, and you are awaiting a response, you do not need to do anything more. We will send you an application form.
  • Thank you for the reply. I just don't understand why they would take it back if a payment plan was in place and regular payments were being made? Then wait nearly 2 years to get back in touch?

    I doubt if anyone on here is going to be able to answer your query - you need to write to Welcome (their Mere Way address), and ask your question to them direct. Tell them you're not happy, so they log itas a complaint.

    As far as your PPI is concerned, if Welcome sold you the car the FSCS will set off against your outstanding balance first. Only once the loan has been paid off will you get anything in cash. You will still be liable to pay the claims management company, regardless of whether your refund is set off or not.

    The CMC you appointed should know how the FSCS refunds work and advised you accordingly.

    Sounds like Welcome didn't sell the debt to Lewis, they just appointed them to recover the debt.

    At some point they have decided they were not happy with the repayment plan/speed at which the debt is being repaid and took the debt back from Lewis (this is fairly common with debt collection).

    Perhaps Welcome (or another debt collector) then were writing to your old address but when you didn't respond and so didn't set up a new repayment plan decided to take court action against you. IND may have been appointed at that point to try to trace you and take court action.

    If the CCJ has just been awarded and if you are in a position to pay in full within a month of the CCJ date then it won't be recorded on your credit file.
