Lots of questions from a very confused person

Hi,

I've been lurking for a while and reading all of your advice/tips etc and finally registered for some specific help (losely translated as 'long time listener, first time caller').

Basically I am currently filling out all the forms for bankruptcy. I was in an IVA which failed and now feel like this is the best option. I have had a telephone meeting with stepchange who were incredibly helpful and went through all of my options with me.

My IVA failed due to a lodger who lost his job and couldnt pay his rent for a while (the IVA arrears ultimately match my lodgers arrears), I couldnt afford to pay my IVA payments and just burried my head in the sand and hoped everything would be ok, obviously it wasn't ok as it has now failed and they have instructed my creditors that they are free to chase me again, which they did almost instantly.

My biggest dilemma is do I declare this lodger? He has successfully secured a new job, but doesnt start until just before christmas, so, while the bankruptcy proceedings and decision happens he wont actually be paying me money. He will be paying me in cash so he won't show up on bank statements and he is registered on the electoral roll at his parent's house. He won't get paid until the 2nd week in January, by which time I am hoping I will have been declared bankrupt.

I have another housemate who pays into my account every month and is on the electoral roll for my address. So obviously I will be including his contributions on my bankruptcy form.

I rent privately from a family member.

Also, I currently use Utility Warehouse for my gas and electric supplier (my housemate is a distributor so I kind of chose them to help him get started), however, as my credit score was so low i couldn't get a mobile contract with anyone and took one out with UW, will this be compromised by my bankruptcy?

How long does it take from filling the form in to getting a court date?

I currently play in a band and have a few gigs booked for early next year, what happens with the fees from the gigs? Will the OR want to take my guitar/amp away?

I currently have a bailiff chasing me for money too, he hasnt been in yet so I havent signed the walking posetion order, how long can I avoid him before they can force there way in? I am house sitting for 2 weeks starting tomorrow so will be away from my house (looking forward to being under the radar for a couple of weeks!).

What are the chances that I may not get declared bankrupt?

In my job I sometimes help out on the kitchen showroom area (I work at B&Q) and have to help customers apply for finance, will I still be able to do this?

Why are my brains falling out of my ears?

Can I have a beer yet?

    Hi guy. I have few answers for you I'm afraid but didn't want to leave the thread unanswered any longer, weekends can be a bit quiet on here but rest assured you'll get lots of advice soon and things will become clearer (and undoubtedly they'll not be as bad as you think they are).

    I'll just answer your last two questions.

  • You are required to inform the o.r of any changes to your incoming and outgoings and sign to say you will.....the previous poster was actually being helpful to you...always be honest if not ..trust me you will be found out and that is fraud.
    br is not to be taken lightly do your research and read everything you can.

Lying is not going to help.

    I rent privately from a family member. Do you have a tenancy agreement for this? I presume you can prove the payments coming out of your bank account anyway?

    What are the chances that I may not get declared bankrupt?Practically nil. I've never heard of it. You need to have taken proper advice, which you will have. Also, obviously you need to not be able to pay your debts when they are due.

    In my job I sometimes help out on the kitchen showroom area (I work at B&Q) and have to help customers apply for finance, will I still be able to do this?Were you credit checked for this role? I guess it will come down to whether you have some special status to allow you to open finance. Do you need to be accreditted to the FSA or anything? The best people to ask is your HR dept. Perhaps annoymously?

If you are going to go BR, don't tell the chasers as they will try twice as hard but just ignore them and focus on getting the BR fees together

He will be paying me in cash so he won't show up on bank statements and he is registered on the electoral roll at his parent's house. I would suggest you need to make this arrangement more formal with evidence of rent paid and a tenancy agreement in place - to protect you as wall as him. He won't get paid until the 2nd week in January, by which time I am hoping I will have been declared bankrupt.

Most Phone companies are fine as long as you don't owe anything when you go BR and carry on making the payments on time. However, if you need to switch phone suppliers in the future, you will probably only get pay as you go as anything that requires a credit check in future will be tricky to get.

    How long does it take from filling the form in to getting a court date? Depends on your local court - some operate an appointment system so you may have to wait a week to so - with others its just a case of turning up and queuing to be seen. You should ring your local court and ask them. The judge (who you may not even see) will want to know (its obligatory) you have sought professional debt advice from one of the charities

The OR will have no interest in talking away anything that is classed as 'tools of a trade' They will be more interested in how much you earn from them.

I am house sitting for 2 weeks starting tomorrow so will be away from my house (looking forward to being under the radar for a couple of weeks!).I don't think a Bailiff is allowed to force their way in! They can only come in and list goods if you invite them. Don't answer the door to the and advise your housemates not to let them in either. Once they are in they can list goods for disposal.

    What are the chances that I may not get declared bankrupt? This would only happen if the judge thinks you haven't taken enough advice

    Why are my brains falling out of my ears? Because BR is a big deal and finance related stress can be quite debilitating. You are doing the right thing working though your options as you are clearly not able to carry on as you are. Take some deep breaths and read all the stickies and keep talking to Stepchange :)
