I was in a iva and have split from my ex partner im a single mum out of work living in rented with a child with a disability
I offered the iva company money to settle with them 6mnths ago and havent heard from them until now
They have started bankruptcy against me and a company is coming round this friday to hand over the letter for bankrupty i have no income and the money i had to pay them has now gone
Now first question is the company coming to hand me a letter do u think it is a baliff wanting to take goods??
Also if i declare Bankrupt what can i lose from my house?
Tv?
Car?
Computer?
Sorry im just a bit worried and have no one to ask on this matter

Hi slippy,
Nobody can take goods from you unless they have a CCJ against you and an Enforcement Order in place, even then they are only allowed to enter your house if you invite them in; you should never do this because once they've been in a house they are allowed to enter it again even if you don't give them permission.
If they turn up at all it will be with a Statutory Demand and if they do petition for your bankruptcy they'll probably be doing you a favour. The only chance you stand of losing things from your house is if you've been ignoring the post and there's a CCJ against you without you realising. Otherwise, you really don't have anything to worry about.
Let us know how things go,
Best regards

They intend to come round this friday
And i have had no mail from dfd or any court orders sent to my address so fingers crossed i will be ok
So u advise me not to let them in the house?0 -
I'd do as richard & bat suggest & dont let them into the house as once they have your permission they can enter again even if your not in at the time of visitingWe all die. The goal isn't to live forever, the goal is to create something that will0

Hi slippy,
It does seem as though it could be a Statutory Demand and that's the first step in petitioning for bankruptcy. When the S.D is served on you, you have approx 14 days to come to an agreement with the creditor who served it, or if not, you can go to Court to defend yourself and make a repayment proposal and the Judge will decide whether it's reasonable or not.
If you've got no surpus income then just let it run it's course. They will then issue a Petition for Bankruptcy and again you have the chance to reach agreement with the creditor or go to Court on the due date.
We were served with a S.D in person and it's no big deal; just a load of semantics really. The point is: Never under any circumstances invite them into your house. If they're serving a S.D they won't need to but just don't take the chance. If they come to the front door, go out the back door and lock it behind you, and vice versa if they go to the back door. If you've only got one door, talk to them through the letterbox, a window, or just open the door quickly and lock it behind you.
I can go into more detail about the procedure if you'd like but until you see what happens on Friday there's not much you can do at the moment. Post again though if you're in any doubt.
Regards

Hi slippy,
Don't forget to shut the window when you've finished talking to them
