Debt recovery plus

Hi, I received a letter from Debt Recovery Plus today regarding a parking ticket we were issued with in July. We were on a day trip to Whitby, parked at the Co op car park at Langborne Road. We paid for our ticket and were back in plenty of time before it ran out. Went home after the holiday, back to Scotland and were surprised to get the ticket through the door. I took advice from an online forum and ignored the letter, then today this gets delivered..

My wife is registered as the keeper but I was driving on the day, does that make any difference?

Any help or advice would be greatly appreciated.

    I think ignore is still correct as your address is in Scotland (even though the "offence" was in England). Hopefully someone better-versed will see this and clarify.

    I think the keeper could write a robust response saying that as they can surely see from the address they have been bombarding with threatograms, the registered keeper lives in Scotland where there is no POPLA, no POFA2012 ansd no 'keeper liability' whatsoever. So as the driver has not been identified, the event was months ago and in any case anyone driving your car would have paid and displayed if required, there is no lawful cause to harass you as keeper. Say that this is a formal complaint that they are writing to the wrong party who is not legally liable at all.

    Have a look at the sticky thread 'newbies...read this now!' (as mentioned in bod1467's signature). It's always stuck permanently near the top of this forum and in it I write about 'robust reponses to a debt collector' and I give a link to a fine thread by retired Solicitor, zzzLazyDaisy with an example of the stance for a keeper to take. In your case the keeper can add in that in Scotland there is no keeper liability (as explained above) so even more reason for the DC to 'cease and desist' and return the file to the originator or this registered keeper will report them.
