She says he hasn't paid...he has

My cousin has recieved a letter from CSA saying he owes over £1000 in child payments. The letter was expected as he has had a falling out with his ex and she said to forget their personal arrangement (cash) she will take him to the CSA instead. The letter is not the problem, he would rather the arrangement be officiated, but judging by the amount she has obviously not declared their personal arrangement and has said he hasnt paid anything. It was only a verbal agreement, how can he prove he actually has been paying?

Contradicition there, how can he prove he has paid? If he's been paying cash in hand more fool him, he may just have to put it down to experience and stay alert in the future, at the same time he should have no remorse the headline price of £1k is only a couple or 3 months worth of CS contribution, it could have been more.0 -
He probably can't !!He has our sympathy ,if she wont admit any money received from him was Child Maintenance he is going to be in for a hard time like we are having.WE had proof of ALL the monthly payments to pwc but she could say it's for anything like debts left at the family home ,loan for a car,money owed to them. We could prove (if they let us!) that the family home was sold,ALL debts were cleared before she received her lump sum from the sale of the house,even kept the car that was paid off )But the CSA weren't interested in seeing any of this!!0

If there wasn't a CSA case open until now it doesn't matter what she says about past payments, the CSA will only deal with the claim from when she applied. If however CSA were already involved but he was paying her direct it will be a lot more difficult for him to prove that he was paying, that happened to my husband a long time ago, he ended up paying twice! I'm not sure how far back they can go in such cases, I seem to remember that his ex said that he owed thousands but they only dealt with the most recent payments, a lot has happened since then so I don't remember exactly.
Make sure he understands that he needs to deal with CSA now and not pay anything else to her direct, even if they have a Direct Pay arrangement make sure he pays by a provable payment method and that it is clearly marked as child support.0 -
Oh yes I forgot about how it depends on how long ago she had contacted the CSA.If its only £1000 that could only be a few months Child Maintenance owing.Our case was open for years as it was when the pwc had to declare when they were on benefits,(now it doesn't matter, the pwc gets to keep it all) We didn't get a letter from CSA in 8 years.Our arrears bill was many times this. Obviously if the pwc (in our case)wasn't happy with receiving money direct she would have said something to the CSA before 8 years went by !! Why can't the CSA work this out ?0
