Employed,but told no work, not paid

    Quit and claim. Remember the role of the JSA is to get people off of benefits regardless of whether it is best for your daughter or not.

    Yes I've suspected for some time that this must happen... my sister wasn't claiming any benefits at all and applied for jobs/sent her cv to all her local supermarkets... didn't even get so much as an acknowledgement from any of them.

    At the same time her complete waster of a neighbour who was on long term benefits (whilst doing cash in hand work) got offered jobs at 4 local supermarkets, all of which he only lasted a couple of weeks in before they were considered 'unsuitable' for one reason or another.

    Always insist in writing something that included the hours, days and the rate of pay.

    In the absence of anything else that will be sufficient.

    One approach might be to put in grievance for non payment of wages in the absence of variable terms they can't put you on short term.

    This might trigger the employer to do something.

    Also check they have the relevant insurances like employee liability.
    Also make sure you keep track of your hours for holiday pay.
  • She has a contract, a verbal contract is a contract. It's just proving it that's hard. She needs to get it writing whether it is a 16 hour contract (in which case obviously they have to give her 16 hours) or whether it is 0 hours. :(
    As someone else has said how long has she worked there? Has she got a history of working this 16 hours (so she can prove it is a 16 hour contract)?

    She should not quit if there is a job to go back to. That would attract a sanction.

    Quick update.
    She went to job centre,they said to apply for Jsa and put work hours down as 5.
    Just spoke to her and the online claim says she is not entitled to claim?
    She gets CHild benefit,Housing benefit,Child tax credit
    Any opinions?
